O presente trabalho discorre sobre a análise da globalização frente à expansão penal. A partir da necessidade de se adequar à aparição de novos bens jurídicos, verificou-se a importância de um aperfeiçoamento no que tange a lei penal em relação aos “novos delitos” existentes e uma avaliação acerca das sanções que devem ser compatíveis com o mesmo. Aborda-se o fenómeno da globalização e as suas consequências para a sociedade moderna, assim como uma possível necessidade de uma Cooperação Internacional para o enfrentamento desta nova realidade, que é a criminalidade virtual. Para tanto, foi realizado um estudo doutrinário acerca do tema, assim como foram expostos os novos elementos presentes do delito. Há um foco no pensamento do jurista Claus Roxin sobre a função do Direito Penal e sobre a ótica do jurista Gunther Jakobs acerca da função do Direito Penal em face de seu funcionalismo sistêmico, bem como possíveis soluções e opiniões a respeito dessa nova modalidade.
The present work discusses the analysis of globalization in the face of penal expansion. From the need to adapt to the appearance of new legal interests, it was verified the importance of an improvement regarding the criminal law in relation to the existing “new crimes”, as well as an evaluation about the sanctions that must be compatible with the same. The phenomenon of globalization and its consequences for modern society are addressed, as well as a possible need for International Cooperation to face this new reality, which is cybecrime. Therefore, a doctrinal study was carried out on the subject, as well as the new elements present in the crime. There is a focus on the thought of jurists Claus Roxin and Gunther Jakobs in relation to the subject, as well as possible solutions and opinions regarding this new modality.
