Será a consagração de um direito de acesso aos tribunais, na CRP, o
bastante para respondermos, de forma efetiva e eficiente, aos conflitos que
emergem numa sociedade marcada pela diversidade?
Em tarefa de pacificação social, a posição de supremacia é ocupada pelos
tribunais. Todavia, não têm sido suficientes para dar uma resposta adequada a
todos os litígios que lhes chegam.
Os cidadãos vêm-se privados da satisfação dos seus direitos e interesses,
de forma efetiva e em prazo razoável, o que gera uma preocupação com a
acumulação de processos, mas também com a qualidade substancial das
soluções apresentadas para os respetivos litígios.
É neste sentido que pensamos nos meios alternativos de resolução de
litígios como mecanismos mais ágeis e suscetíveis de cooperar na prossecução
dos ideais de justiça, de um modo eficiente. Nesta lógica, concretizamos uma
exposição que pode resumir-se em duas partes.
A primeira parte da nossa exposição ocupa-se com uma breve introdução
à atual insuficiência da via judicial e a um possível recurso aos meios alternativos
à tradicional decisão dos tribunais. Concluímos pela atribuição a estes últimos
de uma função de complementaridade na tarefa de pacificação social.
A segunda parte é dedicada à conciliação judicial, obedece a uma
repartição em dois momentos (capítulos 3 e 4) e visa responder ao propósito
desta dissertação: analisar um possível contributo do recurso à conciliação
judicial para a eficiência processual.
Num primeiro momento, facultamos uma noção de conciliação judicial
como uma atividade desenvolvida pelo juiz da causa, que assume o papel de
conciliador, na decorrência de um processo judicial, dotada de um regime próprio
consagrado no CPC e com o propósito de ser alcançado um acordo que se
apresente como a solução que melhor satisfaz os interesses e necessidades das
partes envolvidas num litígio, bem como atentamos no modelo atual do processo
civil, a fim de acautelar uma correta interpretação das disposições alusivas à
conciliação judicial.

Num segundo momento, concentramos a nossa atenção no estudo do
regime do procedimento conciliatório e concluímos que, quando oportuno e
compatível com as particularidades do caso concreto, é a conciliação judicial um
mecanismo apto a contribuir positivamente para a eficiência que se espera do
processo civil.
Is right of access to courts, established in the Constitution of the Portuguese Republic, enough to respond effectively and efficiently to the conflicts that emerge in a society marked by diversity? In the task of social pacification, the prevailing position is occupied by the state courts. However, they have not been sufficient to provide an adequate response to all the disputes that come before them. Citizens are deprived of an effective and expeditious protection as to their rights and interests, which generates a concern with the accumulation of cases, but also with the substantial quality of the solutions presented. In this sense, we think of alternative dispute resolution as more agile and efficient mechanisms which are able to cooperate in the pursuit of the ideals of justice. Through this logic, we have put together a thesis that can be summarised in two parts. The first part deals with a brief introduction to the current insufficiency of the judicial route and a possible recourse to alternative means to state courts. We have concluded by attributing to the latter a complementary function in the task of social pacification The second part, dedicated to judicial conciliation, is divided into two moments (chapters 3 and 4) and it seeks to answer the purpose of this thesis: analyse a possible contribution of the use of judicial conciliation for procedural efficiency. Initially, we provide a notion of judicial conciliation as an activity developed by the judge, who assumes the role of conciliator, in the course of a judicial process, endowed with its own regime enshrined in the Civil Procedure Code and with the purpose of reaching an agreement that presents itself as the solution that best satisfies the interests and needs of the parties involved in a dispute, and we also pay attention to the current model of civil procedure, in order to ensure a correct interpretation of the provisions alluding to judicial conciliation. x In a second instance, we focus our attention on the regime of the conciliation procedure and conclude that, when appropriate and compatible with the particularities of the case at hand, judicial conciliation is a mechanism able to contribute positively to the efficiency that is expected from the civil process.
