| dc.description.abstract | A presente dissertação centra-se no compromisso do Conselho de Segurança das Nações Unidas (CSNU) de 2005 denominado “Responsabilidade de Proteger” (RtoP) e no porquê da sua adoção faria diferença no atual conflito russo-ucraniano, desde o seu inicio a fevereiro de 2022. O estudo tem como objetivo analisar o futuro do Direito Internacional tendo em conta o atual contexto das relações internacionais, com foco no conflito do Leste Europeu, destacando o papel dos Estados e os novos fatores levantados pelo evento. Esta dissertação examina o desenvolvimento da ONU, da ação internacional, da situação do conflito atual, da legislação, dos novos desafios e dos conflitos anteriores para o desenvolvimento do papel da RtoP. O objetivo será, tendo todas essas esferas em consideração, responder à questão principal: deve a norma RtoP ser aplicada neste conflito específico, sendo ainda considerada um conceito válido na esfera do Direito Internacional? | pt_PT |
| dc.description.abstract | This dissertation is focused on the United Nations Security Council (UNSC) commitment from 2005 called “Responsibility to Protect” (RtoP) and why its applicability would make a difference in the current Russian-Ukrainian conflict, since February 2022. The study aims to analyse the future of International Law along with the current context of international relations, focusing on the eastern European conflict, highlighting states' role and new factors raised by the event. This dissertation examines the UN's development, international action, current conflict situation, law, new challenges, and previous conflicts for the RtoP role development. It concludes that some solutions are permissible and functional, but obstacles will persist, necessitating changes in principles, scope of action, and UN structure. The goal is, taking it all into consideration, to respond to the main question: Should the RtoP norm ought to be applied in this specific conflict, being considered a still valid concept on the International Law sphere? | pt_PT |
