Nos últimos anos muito se tem vindo a alterar na lei para contemplar crimes que ainda que recorrentes na nossa história nem sempre foram considerados como tal. Assim, e sendo desde 2000 a violência doméstica um crime público, interessa perceber como este se enquadra no contexto penal português nomeadamente ao nível das condenações. Estando desde 2007 o crime de violência consagrado no código penal português este projeto pretende analisar quais os fatores que levam a que o número de condenações por violência doméstica seja tão baixo, acabando a maioria dos processos por serem arquivados. Este trabalho pretende ser um contributo para a compreensão dos motivos do elevado número de arquivamentos. Para isso em muito contribuiu o estágio realizado na UMAR.
In the fast few years much has been changing in the law to contemplate crimes that still recurrent in our history were not always considered as such. Therefore, since domestic violence has been a public crime since 2000, it is important to understand how it fits within the Portuguese penal context, particularly at the level of convictions. Since the crime of violence enshrined in the Portuguese penal code since 2007, this project intends to analyze the factors that cause the number of convictions for domestic violence to be so weak, with most of them being closed. This work intends to be a contribution to the understanding of the reasons for the high number of filings. For that much contributed the internship at UMAR.
