O objetivo desta dissertação de mestrado é o de selecionar alguns textos periféricos de Michel Foucault à luz da possibilidade de constituírem um contributo válido para um diálogo sobre a questão da equidade. Esta dissertação toma como paradigma o sistema penal para tentar demonstrar a seguinte duplicidade: o poder, mesmo que possa ter uma relação abstrata, genérica e impetuosa com o sujeito, não exclui a livre construção de processos de subjetivação.
Abordam-se os conceitos de poder, de Estado e de homem universal para comentar os trabalhos de Foucault sobre o fenómeno de “psiquiatrização” do sistema penal do século XIX em diante. Esta dissertação procura salientar que o recurso do sistema penal a um certo determinismo psíquico, tal como apresentado pelo autor, é de especial relevância para um discurso sobre equidade que vise o sistema penal. Em paralelo, afirma-se que existe um reduto de relação do poder com a particularidade que um sujeito encerra em si mesmo. É neste reduto que o sujeito pode desenvolver processos de subjetivação.
Com base na relação entre saber e poder e tendo descoberto a interioridade do sujeito no quadro de poder, defende-se uma nova noção de equidade. Esta proposta define a equidade como um direito à diferença, que materializa a possibilidade de um sujeito, na sua relação com o “ver” e “falar” que constituem o saber, utilizar as potencialidades do quadro de poder em que está inserido para criar os seus próprios processos de subjetivação.
The objective of this Master’s dissertation is that of analysing Michel Foucault’s secondary texts with regard to their interest to the topic of equality. This dissertation elects the penal system as a paradigmatic structure: Power, in its abstract, generic and impetuous relationship with the subject, does not exclude freedom and subjectivation. This dissertation comments the phenomenon of psychiatrisation of the penal system from the XIX century onwards, based on the concepts of power, state and universal man. The resource to psychic determinism is of crucial importance to the topic of equality and the penal system. In parallel, there is a stronghold where power builds its relationship with the subject as an entity full of singularities. This is where the subject may constitute himself as such. Keeping in mind the relation between knowledge and power and having discovered the interiority of the subject in the framework of power, a new notion of equality emerges: a right to difference in the context of the seeing and speaking that constitute knowledge. This proposal materialises the possibility of a subject to use the potentialities of the power framework which he is part of and create his own processes of subjectivation.
