A presente dissertação estuda a evolução histórica das atribuições e competências dos municípios no ordenamento jurídico português do património cultural, desde a primeira metade do século XX até à actualidade. No decorrer do trabalho, procuramos identificar, sistematizar e analisar os principais momentos e marcos legislativos dessa evolução – a Lei n.º 2:032, de 11 de Junho de 1949, a Lei n.º 13/85, de 6 de Julho e a Lei n.º 107/2001, de 8 de Setembro – atendendo ao contexto político-administrativo em que se inserem. Deste modo, pretendemos compreender como e quando foi legalmente reconhecido o património cultural de interesse municipal, em que momento e em que medida o Estado transferiu a sua administração para a esfera dos órgãos municipais e como se desenvolveu a articulação entre a administração central e as autarquias locais na salvaguarda do património cultural.
The present dissertation studies the historical evolution of the attributions and competences attributed to municipalities in the Portuguese legal order of cultural heritage, from the first half of the 20th century to the present time. In the course of this project, we sought to identify, systematize and analyze the main moments and legislative milestones of said evolution - Law No. 2:032, from June 11th 1949; Law No. 13/85, from July 6th and Law No. 107/2001, from September 8th - taking into account the political-administrative contexts in which they are inserted. Thus, we seek to understand how and when the cultural heritage of municipal interest was legally recognized, when and to what extent the State transferred its administration to the sphere of municipal entity and how the constant articulation between the central administration and the municipalities has been developed in order to safeguard cultural heritage.
