O impacto das organizações inter-governamentais regionais na resolução dos casos de direitos humanos nos estados soberanos: o caso brasileiro e a Lei Maria da Penha

A presente dissertação visa analisar o impacto da Organização dos Estados Americanos
na afirmação dos direitos da mulher na sociedade brasileira através da Lei Maria da
Penha. Para chegar a este importante momento da história – entrada em vigor da
referida lei para as mulheres brasileiras, o trabalho analisa de forma sucinta a história
dos Direitos Humanos e a sua evolução desde o fim da Segunda Guerra Mundial. Este
último acontecimento foi efetivamente o ponto de partida no panorama internacional
para as grandes transformações de mentalidades e o surgimento de diversas correntes
ligadas à proteção dos direitos do homem em geral e da mulher em particular.
O direito internacional dos direitos humanos será estudado desde a sua origem no plano
internacional, até a sua posterior e efetiva aplicação no plano regional.
De seguida será feita uma análise dos documentos internacionais mais relevantes para
a efetivação desse ‘novo’ direito na ordem jurídica internacional.
As organizações internacionais, sujeitos internacionais fruto dessa evolução, serão
igualmente mencionadas, com especial atenção dada às Organizações Internacionais
Inter-governamentais Regionais, nomeadamente, a OEA.
Os problemas de violência doméstica e disparidades de género, no Brasil, geraram uma
recomendação da Comissão Interamericana de Direitos Humanos para o estado
brasileiro. Por este motivo vamos estudar o sistema de procedimento desse órgão,
juntamente com a Corte Interamericana de Direitos Humanos.
Após consideração desta organização em particular, bem como da atividade
desenvolvida por esta no âmbito dos direitos humanos, é feita uma análise da evolução
histórica da mulher na sociedade brasileira e a problemática da violência doméstica.
Por último, será feita uma análise do impacto dessa organização na resolução dos casos de violência doméstica no Brasil e da sua força de persuasão para a adoção de uma
determinada lei por parte deste Estado soberano, na medida em que todo esse processo
levou a que o Brasil aprovasse a Lei n.º 11/340, conhecida também como Lei Maria da
Penha, que foi sancionada neste Estado, em 7 de agosto de 2006.
The following dissertation will analyze the impact of the Organization of American States on women’s rights in Brazilian society through the Maria da Penha law. Before reaching this important moment in Brazilian history, this essay will analyze the history of Humans Rights and its evolution since the end of World War II. This was an event that gave way to changes in the ways people thought and new philosophies and laws dedicated to the protection of human rights, especially women’s rights. This paper will cover the trajectory of human rights: from its origins to its implementation on a world wide scale. Following this will be a critical analysis of relevant international documents that are responsible for bringing fourth the International Human Rights Law into the international community. International organizations that have been conceived as a result of this law will also be mentioned, and with special attention to inter-governmental organizations such as the OEA. The issues of domestic violence and socioeconomic disparities in Brazil have generated special attention in the Inter-American court and the Court has recommended that the Brazilian state focus on these issues to fully comply with the objective of the Inter-American court. As a result, we will study the legal proceedings of this initiative along with the court. Along with this, there will be an analysis on the transformation of women’s in Brazilian society and issues of domestic violence. Finally, there will be an analysis on the impact this organization has had on the resolution of domestic violence cases in Brazil and its influence on the State in approving the Maria da Penha Law, which was put into effect on August 7th, 2006.
