Esta dissertação surge do facto de se cumprirem em 2016 quinze anos desde a descriminalização do consumo de drogas em Portugal. Tendo como ponto de partida a Lei nº 30/2000 de 29 de novembro, os objetivos do trabalho pretendem avaliar os efeitos que o novo regime jurídico surtiu em Portugal, tanto ao nível dos números relativos ao consumo, tráfico e fenómenos associados - como a mortalidade e as doenças associadas ao consumo -, mas também o efeito que teve na opinião pública e na representação social do consumidor e do consumo de droga.
Através de uma extensa revisão da literatura e análise de relatórios e dados oficiais do European Monitoring Centre for Drugs and Drug Addiction e do Serviço de Intervenção nos Comportamentos Aditivos e nas Dependências, foi possível apurar que a prevalência do consumo ao longo da vida diminuiu, tal como o número de patologias associadas e mortes relacionadas com o consumo de droga. Por outro lado, o número de consumidores em tratamento aumentou e nos tribunais notou-se uma diminuição dos casos relacionados com droga.
Conduziu-se igualmente uma entrevista a um Inspetor-Chefe da Polícia Judiciária, que permitiu confirmar o sucesso da lei. Os inquéritos aplicados à opinião pública concluíram que o consumo de droga continua a ter uma conotação negativa para a maioria da população, mas a maioria está consciente do seu estatuto legal atual.
The idea for this dissertation arises from the commemoration of the fifteen years of the implementation of decriminalization of drug consumption fifteen years since the decriminalization of drug consumption in Portugal. With Law nr. 30/2000 from November 29th as a starting point, this investigation’s goals are to evaluate the effects that the new legal regime had in Portugal, regarding consumption, illegal trade and associated phenomenon - such as mortality and diseases related to drug consumption -, but also its effects in public opinion and social representation of the consumer and the consumption itself. Through an extended bibliographic review and the analysis of reports and official data from the European Monitoring Centre for Drugs and Drug Addiction and Serviço de Intervenção nos Comportamentos Aditivos e nas Dependências it was possible to conclude that the prevalence of life-time consumption has decreased as well as the number of diseases and deaths associated with drug consumption. On the other hand, there are more people in rehabilitation, and courts registered a reduction on drug-related cases. This law’s success was also confirmed by a chief-inspector from Polícia Judiciária through an interview answered by email. Through a questionnaire applied to the general public it was concluded that drug consumption still has a negative connotation for the majority of the population, but most of them are aware of its current legal status.
