In light of the prevalent surge in forced migratory movements witnessed in the 21st century, this study undertakes an analysis of how is gender addressed within the legal framework of EU migration and asylum law. It specifically scrutinises the Common European Asylum System (CEAS) and the potential contribution of the EU’s New Pact on Migration and Asylum (New Pact) to the protection provided to female asylum seekers, focusing on their unique needs, namely protection from sexual and gender-based violence (SGBV), access to secure accommodations, adequate healthcare, and support systems sensitive to trauma and genderbased challenges encountered upon arrival in host countries. The focus will not be on the de iure refugee population, which is already protected under the 1951 Refugee Convention, but rather on female asylum seekers, whose needs require more tailored protection. This research’s aim is to examine the legal reform introduced by the New Pact’s into the CEAS directives, critically evaluating its role in fostering gender-sensitive measures within the asylum process.
