O presente trabalho divide-se em duas partes: um relatório de estágio realizado no Juízo Central Criminal de Sintra e uma dissertação sobre o enquadramento penal da partilha não consentida de imagens íntimas, reais ou manipuladas.
A primeira parte descreve a experiência de quatro meses de estágio, que permitiu um contacto direto com a prática judiciária, nomeadamente, através da assistência a audiências de julgamento, consulta de processos e observação da dinâmica dos tribunais coletivos.
A segunda parte foca-se na problemática crescente da partilha não consentida de imagens sexuais na era digital. Distingue-se o tratamento jurídico da partilha de imagens reais do da partilha de imagens manipuladas, identificando os desafios específicos de cada situação.
Realiza-se uma reflexão crítica sobre o enquadramento penal vigente, incluindo a responsabilidade criminal dos intervenientes quando a partilha ocorre em grupos criados em plataformas digitais com esse propósito.
Neste contexto, parte-se de uma abordagem crítica da Diretiva (UE) 2024/1385 do Parlamento Europeu e do Conselho, que estabelece uma resposta penal uniforme para os Estados-Membros, fixando um patamar mínimo de proteção para as vítimas da partilha não consentida de imagens íntimas.
Com base nesta análise, propõe-se uma alteração legislativa, com o objetivo de reforçar a proteção das vítimas e garantir uma resposta penal mais coerente, eficaz e ajustada às novas dinâmicas da era digital.
This study is divided into two parts: a report on an internship conducted at the Central Criminal Court of Sintra and a dissertation on the legal framework of the non-consensual sharing of intimate images, whether real or manipulated. The first part describes a four-month internship experience, which provided direct contact with judicial practice, namely through attendance at trial hearings, case file reviews, and observation of the dynamics of judicial panels. The second part focuses on the growing issue of the non-consensual sharing of sexual images in the digital age. It distinguishes the legal treatment of sharing real images from that of manipulated images, highlighting the specific challenges each scenario presents. A critical analysis of the current criminal framework is conducted, including the criminal liability of those involved when such sharing occurs within groups specifically created on digital platforms for this purpose. In this context, the study critically examines Directive (EU) 2024/1385 of the European Parliament and the Council, which establishes a uniform criminal response across Member States and sets a minimum level of protection for victims of nonconsensual image sharing. Based on this analysis, a legislative reform is proposed to strengthen victim protection and ensure a more coherent, effective, and appropriate criminal response to the evolving challenges of the digital era.
