O relatório de estágio versa sobre o estágio realizado no Juízo Central Criminal de Almada, durante quatro meses, a partir do qual foi possível ter contacto com a área da criminalidade sexual, que será analisada no âmbito da aplicação do crime de trato sucessivo, utilizado pela jurisprudência portuguesa.
Deste modo, foi possível compreender a evolução social e jurídica dos crimes de Violação e Abuso Sexual de Crianças, e a sua convergência com a problemática da unidade e pluralidade de violações destes ilícitos criminais. Neste contexto surge o crime de trato sucessivo que advém de origem jurisprudencial, a qual lhe conferiu os seus requisitos e espaço de aplicação, que se distingue do crime continuado pelo tratamento que ambas as figuras legais fazem da culpa do arguido. Assim, o crime continuado foi aplicado na criminalidade sexual quando o agente revelou culpa diminuída, ao passo que, o crime de trato sucessivo já foi aplicado quando o mesmo agente revelou culpa acrescida.
Não obstante, procuraremos evidenciar como a aplicação do crime de trato sucessivo, a estes dois tipos legais de crimes, tem sido alvo de decisões diametralmente opostas sobre a verificação dos seus critérios e a sua validade constitucional. Registando-se efeitos práticos e voláteis na vida dos sujeitos processuais envolvidos, quando o tribunal em questão decida pela aplicação ou renúncia do crime de trato sucessivo aos crimes de Violação e Abuso Sexual de Crianças, fazendo variar a escolha e efeitos da pena aplicada ao agente.
The internship report deals with the internship carried out at the Central Criminal Court of Almada, for four months, in the context of which it was possible to have contact with the area of sexual crime, which will be analysed within the scope of application of the crime of successive behaviour, used by Portuguese jurisprudence. In this way, it was possible to understand the social and legal evolution of the crimes of Rape and Sexual Abuse of Children, and their convergence with the problem of the unity and plurality of violations of these criminal offenses. In this context, the crime of successive treatment arises, which comes from jurisprudential origin, giving its requirements and scope of application, which is distinguished from the continuous crime by the treatment that both legal figures make to the guilt of the accused. In which, the continuous crime was applied in sexual crime when the agent revealed diminished guilt, while the crime of successive behaviour has already been applied when the same agent reveals increased guilt. Nevertheless, we will seek to highlight how the application of the crime of successive behaviour to these two legal types of crimes has been the target of diametrically opposed decisions on the verification of its criteria and its constitutional validity. There are practical and volatile effects on the lives of the procedural subjects involved, when the court in question decides to apply or waive the crime of successive behaviour to the crimes of Rape and Sexual Abuse of Children, varying the choice and effects of the penalty applied to the agent.
