O crédito habitação é um dos principais produtos no mercado global, devido ao seu papel na vida dos consumidores e o impulso econômico que tem à escala mundial. Porém, a sua complexidade faz com que os contratos sejam de difícil entendimento para os consumidores, o que constitui um desafio significativo à criação de um mercado hipotecário eficaz e seguro. A crise financeira de 2008 evidenciou as fragilidades do mercado hipotecário, nomeadamente os problemas de sobre-endividamento e a concessão de crédito de forma irresponsável. Face a isso, a UE implementou a Diretiva 2014/17/UE, a fim de harmonizar as normas que regem os contratos de crédito habitação, proteger os consumidores e promover um mercado mais transparente e eficaz.
A Diretiva introduziu algumas novidades, em especial o direito ao reembolso antecipado, a fim de proporcionar uma flexibilidade financeira ao consumidor. Contudo, a ausência de um método de cálculo para a redução proporcional dos custos do crédito, em caso de reembolso antecipado, gera insegurança jurídica, pois se perde o elemento da previsibilidade e estabilidade das normas jurídicas.
O objetivo deste trabalho consiste em identificar a lacuna existente na regulamentação do direito ao reembolso antecipado. O estudo aborda o conceito de crédito à habitação como contrato de consumo, a harmonização legislativa na UE e os custos associados ao contrato de crédito à habitação. A
análise jurisprudencial realizada permite propor soluções para a criação de um método de cálculo proporcional para a redução de custos no reembolso antecipado, de modo a promover um maior equilíbrio entre as partes e garantir uma maior segurança jurídica para o consumidor.
Mortgage credit is one of the main products on the global market, due to its role in consumers' lives and the economic boost it has on a worldwide scale. However, its complexity means that contracts are difficult for consumers to understand, which is a significant challenge to creating an effective and safe mortgage market. The 2008 financial crisis highlighted the weaknesses of the mortgage market, in particular the problems of over-indebtedness and irresponsible lending. In light of this, the EU implemented Directive 2014/17/EU in order to harmonize the rules governing mortgage credit contracts, protect consumers and promote a more transparent and efficient market. The Directive introduced some new features, in particular the right to early repayment, in order to provide financial flexibility for the consumer. However, the absence of a calculation method for the proportional reduction of credit costs in the event of early repayment creates legal uncertainty, as the element of predictability and stability of legal rules is lost. The aim of this paper is to identify the gap in the regulation of the right to early repayment. The study addresses the concept of mortgage credit as a consumer contract, legislative harmonization in the EU and the costs associated with the mortgage credit contract. The jurisprudential analysis carried out makes it possible to propose solutions for the creation of a proportional calculation method for the reduction of costs in early repayment, in order to promote a greater balance between the parties and guarantee greater legal certainty for the consumer.
