A presente dissertação propõe-se a responder como a técnica denominada Dispute Systems Design (Desenho de Sistemas de Resolução de Disputas – DSD) contribui para o arcabouço jurídico tradicional, apresentando uma alternativa eficiente para prevenir, gerenciar e resolver disputas, proporcionando maior celeridade e satisfação às partes envolvidas. O tema resulta da demanda social por soluções jurídicas mais criativas, capazes de enfrentar a crescente complexidade das relações humanas. A primeira parte,
focada no recorte teórico, explora a origem, os princípios, os objetivos e as etapas do DSD. A segunda parte examina a aplicação prática da técnica no sistema de resolução de disputas desenhado para atender os atingidos do rompimento da Barragem I, da Mina Córrego do Feijão, em Brumadinho, Minas Gerais, da empresa brasileira de mineração, Vale S.A., em janeiro de 2019. A escolha deste caso decorre da participação ativa do autor no desenho e implementação do DSD, atuando como coordenador executivo da equipe de facilitadores. A partir da comparação dos resultados empíricos obtidos por este sistema de resolução de disputas com aqueles alcançados nos tribunais, o trabalho demonstra que a técnica do DSD pode aprimorar o arcabouço jurídico tradicional dos métodos adequados de resolução de disputas.
This dissertation seeks to explore how the technique known as Dispute Systems Design (DSD) enhances the traditional legal framework by offering an efficient alternative for preventing, managing, and resolving disputes, thereby providing greater efficiency and satisfaction to the parties involved. The selection of this topic is driven by the growing societal need for more creative legal solutions capable of addressing the increasing complexity of modern human interactions. The first section focuses on the theoretical foundation of DSD, examining its origins, principles, objectives, and key stages. The second section evaluates the practical application of DSD through the dispute resolution system developed for those impacted by the collapse of Dam I at the Córrego do Feijão mine in Brumadinho, Minas Gerais, in January 2019, a disaster involving the Brazilian mining compan y Vale S.A. The case was chosen due to the author's direct involvement in the design and implementation of the DSD, serving as the executive coordinator for the team of facilitators. By comparing the empirical outcomes of this dispute resolution system with those achieved through traditional court proceedings, this dissertation demonstrates how DSD can effectively complement and enhance conventional dispute resolution mechanisms.
