This thesis explores the legal and technological tools for safeguarding individual informational self-determination and enhancing control over personal data in the context of today’s challenges in data protection governance, from the premise that privacy is at the very core of essential aspects of human rights, entailing personal freedom, autonomy, and civil liberties. As technologies draw more physical information into the digital sphere, privacy protection becomes more complex. Individual autonomy and control are being reshaped and challenged by algorithmic inferences, automated decisions or dark patterns, requiring meaningful and future-proof solutions. This thesis contends that the current notice and consent model for data collection falls short in safeguarding data privacy within the dynamic landscape of online services. The accelerated pace of technological advancements and a pervasive lack of individual awareness aggravate privacy challenges. To address these concerns, this thesis proposes the concept of Data Self-Sovereignty as an alternative data governance model. This paradigm aims to empower individuals with enhanced control over their data through legal and technological tools. Based on the understanding that the problems arising within the current privacy relations are based on the lack of control over information flows, we will delve into the application of privacy by design as a pivotal aspect of data governance, encompassing a significant shift in technologies, business practices, and legal frameworks if implemented. Therefore, this approach emphasises the potential of technological architecture for minimising informational imbalances. From a holistic perspective, Data Self-Sovereignty integrates legal and technological mechanisms to develop a more robust framework for addressing the challenges posed by advanced technologies and their impact on privacy. By unveiling the potential of Data Self-Sovereignty as a transformative governance solution, this thesis advocates for a proactive and comprehensive approach to data privacy, aligned with the evolving digital landscape to ensure the implementation of effective safeguards for protecting individual rights within contemporary data practices.
