O presente estudo é o culminar de quatro meses de estágio curricular no Juízo Central Criminal de Aveiro. Entre o estudo de processos, a assistência a audiências e a elaboração de projetos de decisão, destacou-se o problema de saber se a valoração das declarações para memória futura prestadas anteriormente por declarante que em audiência de julgamento se recusou validamente a depor era possível. Durante o estudo do regime das declarações para memória futura por forma a responder a tal questão, tornou-se claro que a sua aplicação prática suscitava outros problemas nas fases preliminares do processo, cujas soluções são
ainda muito discutidas. Destacam-se a existência de restrições temporais à sua realização, os parâmetros do requerimento suscetíveis de controlo pelo juiz de instrução e a sua recolha sem a prévia constituição de arguido. O presente estudo visa, essencialmente, apreciar as várias posições existentes na doutrina e jurisprudência nacionais sobre todas estas questões, culminando em soluções que permitam harmonizar os princípios e finalidades em conflito à luz do regime jurídico atualmente em vigor, contribuindo, deste modo, produtivamente para a discussão.
This study is the culmination of a four-month internship at the Aveiro Central Criminal Court. Between studying cases, attending hearings and drafting decisions, the problem of knowing whether it was possible to value statements for future memory previously made by a declarant who validly refused to testify at a trial hearing stood out. During the study of the system of statements for future memory in order to answer this question, it became clear that its practical application brought other problems in the preliminary stages of the process, the solutions to which are still much debated. We are talking in particular about the existence of time restrictions on the taking of statements, the parameters of the request that can be controlled by the investigating judge and the taking of statements without the prior constitution of a defendant. This study essentially aims to assess the various existing positions in the national doctrine and jurisprudence on all of these issues, culminating in solutions that make it possible to harmonize the conflicting principles and purposes, in the light of the legal regime currently in force, thus contributing productively to the discussion.
