A resposta ao terrorismo no ordenamento jurídico português e europeu: da fronteira entre a liberdade de expressão e os crimes de incitamento e apologia

O terrorismo constitui, atualmente, uma séria ameaça, reforçada pelo desenvolvimento digital. Este estudo aborda a resposta ao fenómeno do terrorismo, em particular o seu incitamento e apologia, especialmente online. Analisando o desenvolvimento do terrorismo e a evolução histórica da sua criminalização, é evidente a importância do papel desempenhado por organizações internacionais e, em particular, pela União Europeia na sua regulação. São examinadas as disposições legais atualmente aplicáveis no ordenamento jurídico português e, em comparação, noutros sistemas jurídicos europeus. O impacto na liberdade de expressão é discutido, assim como as críticas aos preceitos incriminadores, investigando a legitimidade dessas normas enquanto restrições àquele direito fundamental.
A recente obrigação de remoção de conteúdo terrorista online prevista na legislação europeia e a sua implementação nacional são também exploradas, as quais levantam sérias preocupações sobretudo no que concerne às entidades responsáveis pela decisão de remoção.
Terrorism is currently a serious threat, reinforced by digital development. This study addresses the response to the phenomenon of terrorism, in particular its incitement and apology, especially online. By analyzing the development of terrorism and the historical evolution of its criminalization, it is evident the importance of the role played by international organizations and, in particular, by the European Union in regulating it. The legal provisions currently applicable in the Portuguese legal system and, by comparison, in other European legal systems are examined. The impact on freedom of expression is discussed, as are criticisms of the incriminating provisions, investigating the legitimacy of these rules as restrictions on this fundamental right. The recent obligation to remove terrorist content online foreseen in European legislation and its national implementation are also explored, which raise serious concerns, especially regarding the entities responsible for the removal decision.
