A responsabilidade civil emergente da detenção de veículos automóveis dotados de IA (Inteligência Artificial)

Abstract

Perante o atual estado da ciência teme-se que o legislador não consiga acompanhar o desenvolvimento galopante dos sistemas de Inteligência Artificial. Quem deve ser o responsável pelos danos que, eventualmente, a máquina autónoma cause? A ausência, à data, de uma solução legal satisfatória levanta questões jurídicas de natureza diversa, que apenas serão respondidas mediante a cooperação entre os diversos agentes do mercado e o legislador. Esta dissertação procura analisar, em especial, o Ordenamento Jurídico Português e averiguar se o mesmo se revela apto para dar resposta às interrogações provocadas pela aplicação da Inteligência artificial aos veículos automóveis. O cenário legal internacional também não oferece ainda uma resposta definitiva, segura ou uniforme quanto ao referido problema. Entre avanços e recuos – tendo em conta a elevada densidade técnica do tema –, é necessário, em primeiro lugar, perceber o que se entende por “veículo autónomo” e só depois se deve partir para o esboço da solução legal, de forma a delimitar-se, desde as fases mais embrionárias dos projetos legislativos, o seu âmbito de aplicação.

Given the current state of science, it is feared that the legislator will not be able to keep up with the galloping development of Artificial Intelligence systems. Who should be responsible for any damage that the autonomous machine may cause? The absence, to date, of a satisfactory legal solution raises legal questions of a diverse nature and which will only be answered through cooperation between the various market agents and the legislator. This dissertation seeks to analyze, in particular, the Portuguese Legal System and determine whether it is capable of responding to the questions raised by the application of Artificial Intelligence to motor vehicles. The international legal scenario also does not yet offer a definitive, safe or uniform answer to this problem. Between advances and setbacks – considering the high technical density of the topic –, it is necessary, firstly, to understand what is meant by “autonomous vehicle” and only then should we move on to drafting the legal solution in order to define, from the most embryonic stages of legislative projects, their scope of application.
