Em tempos onde a palavra sustentabilidade é tida como obrigatória no vocabulário
corporativo, escolhemos analisar o papel que a lei tem na sua concretização. Para alcançar
sustentabilidade no mundo corporativo, impera fazer uma análise compreensiva entre a
prática empresarial e os Direitos Humanos.
Escolhemos um foco na Igualdade de Género, por ser uma parte pertinente no
desenvolvimento das nossas sociedades. Além disso, consideramos que a conjuntura
presente é a ideal para criar tanto políticas públicas, como um quadro legal adequado para
salvaguardar o fim da persistência da desigualdade de género tanto para as gerações
futuras. O objetivo primordial desta dissertação passa por conduzir uma análise da
situação de igualdade de género, com um foco no quadro legal da União Europeia. Para
além disso, procuramos analisa os standards internacionais relacionados com a interseção
entre a prática empresarial e os Direitos Humanos.
Através desta dissertação, concluímos que a mais recente proposta de diretiva da União
Europeia em Responsabilidade Corporativa tem potencial para promover a igualdade de
Género dentro das cadeias de abastecimento globais. A ausência de referências explícitas
e de mecanismos adequados para lidar com o problema da desigualdade de género leva a
que o ónus de adoção de medidas que considerem a igualdade de género fique do lado
das empresas.
In an era where the term sustainability is increasingly integrated into the vocabulary of the corporate sphere, we choose to contemplate the role that the law plays in its enforcement. In order to achieve corporate sustainability, it is imperative to undertake a comprehensive examination of the intersection between business practices and human rights. We focus on Gender Equality, as it assumes an increasingly significant role in the development of our societies. Moreover, we consider this is the perfect moment in time to establish legal frameworks and policies that safeguard future generations of the patriarchal status quo. The primary objective of this dissertation is to conduct an analysis of Gender Equality, with a particular focus on the legislative framework inside the European Union. Additionally, it seeks to examine the intersection of Business and Human Rights, specifically exploring the international norms that govern both. Through this analysis, it can be concluded that the European Corporate Sustainability Due Diligence Draft Directive holds the potential to promote gender equality within global value chains. The absence of explicit references and mechanisms to address gender equality is one of the biggest criticisms of this draft directive, therefore allowing companies to adopt gender awareness strategies on their own.
