A aplicação da perequação ao nível do planeamento e execução urbanística tem suscitado muita controvérsia, quanto à sua validade enquanto instrumento integrador e facilitador da execução dos planos. Por exigência do quadro legal, os PU e PP devem definir mecanismos perequativos que garantam a redistribuição de benefícios e encargos inerentes ao modelo de ocupação proposto, contudo nem todos aplicam estes mecanismos na execução das operações urbanísticas que implementam as opções dos planos, condicionando a eficaz e eficiente execução. Na região do Algarve, após o lançamento aos serviços técnicos das câmaras municipais de um inquérito sobre a aplicação perequação, os planos e a realidade socio-urbanística dos municípios, constatou-se que, os planos analisados apresentam uma reduzida execução, podendo as causas ser múltiplas, desde as realidades socio-urbanísticas específicas dos municípios à dificuldade generalizada em interpretar e cumprir as disposições dos planos, sobretudo os mecanismos perequativos por parte dos diversos intervenientes envolvidos. É então essencial perceber se as dinâmicas urbanísticas, sociais e económicas têm ligação com os mecanismos perequativos dos planos, por forma a concluir-se se a execução dos planos está condicionada por uma realidade não favorável ou se a perequação tem limitado a boa execução dos planos. Importa compreender quais as causas e reforçar soluções, que poderão não ser imediatas, mas que construam um caminho e uma futura estratégia, na abordagem à execução urbanística por parte dos diversos agentes.
The application of equalization in urban planning and execution has raised much controversy as to its validity as an integrating and facilitating instrument in the execution of plans. As required by the legal framework, PU and PP must define equalization mechanisms that ensure the redistribution of benefits and burdens inherent in the proposed occupation model, however, not all of them apply these mechanisms in the execution of urbanistic operations that implement the options of the plans, conditioning the effective and efficient execution. In the Algarve region, after launching a survey to the technical services of the municipalities on the application of equalization, the plans and the socio-urban reality of the municipalities, it was found that the analyzed plans have a low implementation, the causes may be multiple, from the specific socio-urban realities of the municipalities to the general difficulty in interpreting and complying with the provisions of the plans, especially the equalization mechanisms by the various actors involved. It is therefore essential to understand whether the urban, social and economic dynamics are linked to the equalization mechanisms of the plans, in order to conclude whether the execution of the plans is conditioned by an unfavorable reality or whether equalization has limited the proper execution of the plans. It is important to understand the causes and strengthen solutions, which may not be immediate, but which build a path and a future strategy in the approach to urban execution by the various agents.
