A política de asilo da União Europeia

Abstract

The issue of asylum policy in the European Union has been the subject of numerous studies and discussions, in which an attempt is made to reach a consensus on the uniform application of European asylum law within the bloc. In this context, this study proposes to analyze the bases that gave rise to this right, in the international and European scope, remembering the values that were the trigger for the protection of these people who arrive in European territory in need of international protection. It is also important to understand the social and political factors that surround this issue in the European context, such as the growth of Euroscepticism and the problematic expansion of populism in European countries, which present strong resistance to refugees and immigrants in general, such as Hungary, the main focus of this analysis. The different dynamics of countries that have borders external to the Schengen Area are highlighted, as well as how there must be a balance between the principle of solidarity and national sovereignty. It is also necessary to bring to this study the conditions of waiting and reception of these people, conditions that are clearly precarious, and respect for the principle of non-refoulement. Finally, it will be addressed the need to redistribute the responsibility for asylum in the European Union, through improvements to the Dublin Regulation, as well as the prospects for change in European asylum policy.

A questão da política de asilo na União Europeia tem sido alvo de numerosos estudos e discussões, em que se tenta alcançar um consenso sobre a aplicação do direito de asilo europeu de forma uniforme dentro do bloco. Neste contexto, este estudo se propõe a analisar as bases que deram origem a este direito, no âmbito internacional e europeu, relembrando os valores que foram o gatilho para a proteção destas pessoas que chegam ao território europeu necessitando de proteção internacional. Importa também compreender os fatores sociais e políticos que contornam esta questão no contexto europeu, como o crescimento do euroceticismo e a problemática expansão do populismo em países europeus, os quais apresentam forte resistência a refugiados e imigrantes de maneira geral, como ocorre na Hungria, foco principal desta análise. Destaca-se a dinâmica diferenciada dos países que contam com fronteiras externas ao Espaço Schengen e como deve haver um equilíbrio entre o princípio da solidariedade e da soberania nacional. Necessário trazer a este estudo, também, as condições de espera e acolhimento destas pessoas, as quais são manifestamente precárias, e o respeito ao princípio do non-refoulement. Por fim, será abordada a necessidade de redistribuição da responsabilidade de asilo na União Europeia, através de melhoras ao Regulamento de Dublin, assim como as perspectivas de mudança na política de asilo europeia.
