Branqueamento de capitais e financiamento do terrorismo nos jogos e apostas online

Abstract

This dissertation focuses on the analysis of online gambling and betting in Portugal and its regulation on the prevention and fight against money laundering and terrorist financing. To this end, the study focuses on the analysis of the concept of online gambling and the mechanisms that this practice has for money laundering and terrorist financing crimes. The objective of this assignment is to analyse the weaknesses intrinsic to online gambling and betting, how the weaknesses identified were combated and future steps in this area to ensure the minimisation of the potential risk of money laundering and terrorist financing in this way. Given the two questions asked in this dissertation, we will analyse the reasons that led to the creation of a specific legislative document for online gambling and betting, as well as the need for the evolution of the regulation of online gambling and betting to a European overview, always identifying its advantages and disadvantages. Thus, it is intended at the end of this dissertation to present an answer as clear as possible to the two questions under analysis.

A presente dissertação foca-se na análise dos jogos e apostas online em Portugal e a sua regulação na matéria concreta da prevenção e combate ao branqueamento de capitais e financiamento do terrorismo. Para tal, o estudo recai sobre a análise do conceito de jogos e apostas online e os mecanismos que, neste particular contexto, podem dar cobertura a crimes de branqueamento de capitais e financiamento do terrorismo. O objetivo deste trabalho consiste na análise das fragilidades intrínsecas aos jogos e apostas online, o modo como as fragilidades identificadas foram combatidas e as diligências futuras neste âmbito para assegurar a minimização do risco potencial de branqueamento de capitais e financiamento do terrorismo. Em face das duas questões colocadas nesta dissertação, analisaremos as razões que levaram à criação de um documento legislativo específico para os jogos e apostas online, bem como a necessidade de evolução da regulação dos jogos e apostas online para um panorama europeu, identificando, sempre, as suas vantagens e desvantagens. Posto isto, pretende-se no final da presente dissertação apresentar uma resposta tão clara quanto possível às duas questões em análise.
