Resumo(s)
Objetivos: Por uma análise doutrinária e documental, a presente dissertação
objetiva analisar os desafios para a implementação do Novo Acordo de
Implementação, vinculante à UNCLOS, sobre conservação e uso sustentável da
biodiversidade marinha de áreas além da jurisdição nacional, especialmente no que
diz respeito às fragilidades concernentes sobre o regime de pesquisa científica
marinha e as implicações sobre o desenvolvimento de capacitação e transferência
de tecnologia marinha.
Metodologia: O estudo apresentado tem como metodologia a pesquisa
exploratória e descritiva, sendo os seus resultados tratados de forma qualitativa, a
partir da coleta de informações em fontes secundárias e através de uma análise
dogmática-jurídica, utilizando-se de escopo interdisciplinar, qual seja, o direito, a
política e a ciência.
Resultados: No processo de condução da pesquisa foi possível concluir que para
uma efetiva implementação do BBNJ é preciso avançar as discussões sobre os
elementos-chave e desenvolver propostas ambiciosas para o fortalecimento
desses fatores no escopo do acordo, bem como para a integração destes para o
alcance dos objetivos.
Contribuições: A principal contribuição da investigação consiste em apontar
sugestões práticas e eficazes para a devida implementação do BBNJ.
Objectives: Through a doctrinal and documentary analysis, this current dissertation analyzes the challenges for the implementation of the New Implementation Agreement, binding on UNCLOS, on the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction, especially concerning the weaknesses of the marine scientific research regime and the implications on the development of capacity-building and transfer of marine technology. Methodology: The study presented has as methodology the exploratory and descriptive research, and its results are treated qualitatively, from the collection of information in secondary sources and through a dogmatic-legal analysis, using interdisciplinary scope, namely, law, politics and science. Results: In the process of conducting the research it was possible to conclude that for an effective implementation of BBNJ it is necessary to advance the discussions on the key elements and to develop ambitious proposals for the strengthening of these factors in the scope of the agreement, as well as for their integration for the achievement of the objectives. Contributions: The main contribution of the research is to highlight practical and effective suggestions for the proper implementation of the BBNJ.
