Esta dissertação tem por objetivo analisar, de forma qualitativa, uma das questões mais controversas e de difícil resolução para as Relações Internacionais devido à existência de uma Sociedade Internacional que se encontra assente em princípios como a soberania, não-ingerência e o não-uso da força. Com o fenómeno da globalização e o consequente surgimento de uma conflitualidade contemporânea, com novas ameaças e onde os conflitos são mais internos do que entre Estados, a população acaba por ser a maior vítima destas mesmas situações. É por essa mesma razão que se pretende compreender a relevância deste conceito tão controverso para uma defesa efetiva dos Direitos Humanos. Tendo em vista este objetivo, é apresentada nesta investigação uma pergunta de partida que serve de base para toda a investigação e reflexão apresentadas neste trabalho, isto no sentido de chegar a uma conclusão o mais rigorosa possível. De forma a efetuar uma análise mais cuidada e mais próxima da realidade no que concerne à temática das intervenções humanitárias, o trabalho é ainda alicerçado em dois estudos de caso que possibilitarão a construção de uma visão mais crítica acerca das intervenções humanitárias e das suas implicações: os casos líbio e sírio. Desta forma, o grande objetivo desta mesma investigação é verificar se, apesar de todas as críticas e problemáticas que suscita, a intervenção humanitária é um instrumento universal de defesa dos Direitos Humanos.
This study aims to analyze, in a qualitative way, one of the most controversial and difficult issues for International Relations due to the existence of an International Society still based on principles such as sovereignty, non-interference and non-use of strength. With the phenomenon of globalization and the consequent emergence of contemporary conflicts, with new threats and where conflicts are more internal than between States, the population ends up being the biggest victim of these specific situations. Therefore, it is crucial to understand the relevance of this controversial concept for an effective defense of Human Rights. In view of this objective, a starting question is presented in this investigation that serves as the basis for all the investigation and reflection presented in this work, this to reach a conclusion as much rigorous as possible. To carry out a more careful analysis and closer to reality regarding the theme of humanitarian interventions, the study is also based in two case studies that will enable the construction of a more critical view of humanitarian interventions and their implications: the Libyan and Syrian cases. Thus, the main objective of this same investigation is to verify whether, despite all the criticisms and problems it raises, humanitarian intervention is a universal instrument for the defense of Human Rights or not.
