RESUMO - Este estudo teve como objetivo principal analisar o modelo político-legislativo sobre
prostituição vigente em Portugal através do olhar de quatro vertentes: legislações e tratados
internacionais, saúde pública, comparação do modelo português com dois modelos distintos
(Holandês e Sueco) e, por fim, movimento feminista. Neste contexto, o foco do debate é avaliar
se a realidade da prostituição na sociedade portuguesa, que criminaliza parcialmente o setor,
garante direitos básicos aos trabalhadores do sexo, como o direito ao acesso à saúde,
garantido pela constituição portuguesa. O conhecimento e discussão dessa realidade tornase
urgente, uma vez que a realidade vivida pelos trabalhadores do sexo em Portugal revela
falhas na garantia dos direitos humanos, marginalizando ainda mais uma população já
marginalizada. Espera-se, assim, que as reflexões trazidas neste trabalho sirvam para
repensar a estratégia político-legislativa portuguesa, com atenção especial às estratégicas de
intervenção em saúde pública, de forma que, daqui por diante, políticas públicas sejam
desenhadas dentro do limite do respeito à dignidade humana e da garantia de direitos
fundamentais.
ABSTRACT - This study sought to assess the regulatory approach to prostitution that Portugal has adopted through the analysis of fours facets: international law and treaties, public health approach, the comparison between the Portuguese approach and two distinct models (Dutch and Swedish), as well as through the feminist movement point of view. In this respect, the focus of the discussion brought up throughout this study is to analyze whether or not the Portuguese approach, which partially criminalize prostitution, safeguards basic rights to sex workers, such as the constitutionally guaranteed right to healthcare. It is crucial to discuss the reality of those involved in the prostitution in Portugal, once it’s already evident that this reality shows signs of noncompliance with human rights laws, hence marginalizing even more an entire population that is already marginalized. It is expected, therefore, that the analysis carried out by this study prompt a reevaluation of the Portuguese legal and political strategies towards prostitution, with special attention to public health interventions’ strategies, which shall be drawn respecting the limits imposed by human dignity and fundamental rights.
