Intellectual Property and the Pharmaceutical Industry – An Economic Analysis is a brief literature review of the most relevant works on the issue of IP Law in Pharmaceuticals, especially in what patents are concerned. Referring to simple models, this paper highlights the trade-off between the dynamic efficiency of intellectual property rights in encouraging R&D and the static inefficiency created by a monopolistic situation. Ultimately, it discusses the existence of better systems of aligning incentives between the pharmaceutical industry and society and concludes that the benefits provided by the current patent system can overcome its failures.
