| dc.description.abstract | Due to the evolution of the concept of family and the introduction of affection to family relationships, it is necessary to approach the rules of protection for the family, marriage and children and adolescents. In view of this, the dissertation aims to clarify from a constitutional, procedural, civil and criminal perspective, the definition and characterization of the aspects involving Parental Alienation and Parental Alienation Syndrome (SAP) in the context of the marital dispute after the rupture of the relationship, as well as the form of proof of its occurrence and consequent violation of children's fundamental rights and family life. International treaties dealing with children's rights and parental responsibilities are discussed, in addition to the regulation given to the subject from the perspective of Comparative Law between Brazil and Portugal. Furthermore, we will deal with the fragility of affective bonds in contemporary times through the association of Zigmunt Bauman's theory to Parental Alienation. It is also about the inexistence of a specific law on the subject in the Portuguese legal system in opposition to the Brazilian Law n.º 12.318/2010. Although there is no law on the subject, Portugal has sparse rules in the Penal Code, Civil Code and Law n.º 147/1999 (Law for the protection of children and young people in danger), among others, which aim to protect children's rights. The theme is relevant because the object of study deals with children's rights to which full protection is granted due to the peculiar condition of a person in development, which is why it is up to the Judiciary to repress any conduct that violates the guarantees to they assured. | pt_PT |
| dc.description.abstract | Em razão da evolução do conceito de família e introdução da afetividade às relações familiares, faz-se necessária a abordagem a respeito das normas de proteção à família, ao casamento e às crianças e adolescentes. Diante disso, a dissertação tem por escopo esclarecer sob a ótica constitucional, processual, civil e penal, a definição e a caracterização dos aspectos que envolvem a Alienação Parental e a Síndrome de Alienação Parental (SAP) no contexto da disputa conjugal após a ruptura do relacionamento, bem como a forma de comprovação de sua ocorrência e consequente violação a direitos fundamentais infanto-juvenis e à convivência familiar. Abordar-se-ão os tratados internacionais que abordam direitos infantis e as responsabilidades parentais, além da regulamentação dada ao tema na perspectiva de Direito Comparado entre Brasil e Portugal. Outrossim, trataremos da fragilidade dos laços afetivos na contemporaneidade através da associação da teoria de Zigmunt Bauman à Alienação Parental. Tratar-se-á da inexistência de Lei específica sobre o tema no ordenamento jurídico português em contraposição à Lei Brasileira n.º 12.318/2010. Embora não haja Lei sobre o assunto, Portugal dispõe de normas esparsas no Código Penal, Código Civil e na Lei n.º 147/1999 (Lei de proteção de crianças e jovens em perigo), dentre outras, que visam tutelar os direitos infantis. A temática mostra-se pertinente em razão do objeto de estudo tratar de direitos infanto-juvenis aos quais é deferida a proteção integral decorrente da condição peculiar de pessoa em desenvolvimento, razão pela qual cabe ao Poder Judiciário reprimir quaisquer condutas que atentem contra as garantias a eles asseguradas. | pt_PT |
