Discussões sobre justiça intergeracional tendem para conclusões que não nos permitem avançar com propostas definitivas sobre a melhor forma de acautelar os interesses das gerações futuras sem prejuízo das atuais instituições democráticas. Das discussões sobre o poder que as gerações têm umas sobre as outras, à dificuldade que as instituições democráticas têm para resolver problemas que resultam de si mesmas, e a possibilidade de causar danos a pessoas futuras resulta um impasse sobre a melhor forma de acautelar os interesses dos que hão de vir. Por pretendermos fugir a este impasse recorremos ao caráter de excecionalidade de uma figura jurídica como a do estado de necessidade como meio capaz de incorporar o agir de movimentos ativistas que e ajam na defesa dos interesses das gerações futuras. Deste modo, a ação direta, do tipo ativista, age em articulação com o poder judicial conferindo aos tribunais uma possível doutrina intergeracional.
Discussions regarding intergenerational justice veer towards to conclusions that do not allow us to forward concrete proposal over the best way to care for the interests of future generations without compromising current democratic institutions. From the discussions over the power exerted between generations, to the challenges of democratic institutions to resolve issues they themselves create, and the possibility to cause harm to future people gives way to an impasse over the best way to care for the interests of those who are still to come. Because we wish to avoid this impasse we turn to the exceptionality character of a legal concept such as the law of necessity as a means able to subsume the actions of activist movements that act in the defense of future generations. Thus, direct action acts in articulation with the judicial power granting the courts a viable intergeneration doctrine.
