Esta dissertação investiga como deve ser tratado o criminoso a partir do aforismo §202 de Aurora, onde Nietzsche afirma que não existe qualquer diferença essencial entre criminosos e doentes mentais e recomenda uma benevolência médica. Definimos o conceito de criminoso na filosofia do direito penal e reconstruímos genealogicamente a figura do criminoso em Nietzsche, para captar a pluralidade de sentidos que atravessa a sua análise da punição. Em seguida, enquadramos a analogia com o doente mental, primeiro no plano da filosofia da psiquiatria e depois na obra de Nietzsche, mostrando a sua ligação a uma teoria da ação e à crítica do livre-arbítrio. Por fim, avaliamos o retributivismo, o consequencialismo penal e o abolicionismo à luz de várias teses de Nietzsche, averiguando se é possível extrair uma resposta positiva à pergunta sobre o tratamento do criminoso.
This dissertation investigates how the criminal ought to be treated on the basis of aphorism §202 of Daybreak, where Nietzsche claims that there is no essential difference between criminals and the mentally ill and recommends medical benevolence. We define the concept of the criminal within contemporary philosophy of criminal law and provide a genealogical reconstruction of the criminal figure in Nietzsche in order to capture the plurality of meanings that runs through his analysis of punishment. We then frame Nietzsche’s analogy with mental illness, first within philosophy of psychiatry and then within Nietzsche’s own work, showing its connection to a theory of action and to a critique of free will. Finally, we assess retributivism, penal consequentialism, and abolitionism in light of several Nietzschean theses, asking whether it is possible to extract a positive answer to the question of how the criminal should be treated.
