dc.description.abstractIn the Gulf of Guinea region, where São Tomé and Príncipe (STP) is located, illegal unreported and unregulated fishing (IUU fishing) threatens one of the most valuable resources of the STP food and economy. Despite the existence of a legal frameworks, and the establishment of a Coast Guard (GC) in STP, IUU fishing continues to be present. This study then attempts to analyze how the CG, in current circumstances, can contribute to the mitigation or elimination of IUU fishing, the threat that takes, annually, about US $ 1.5 billion from the Gulf of Guinea region (RGG) where STP is located. For that, inductive reasoning was used with a qualitative research strategy involving document analysis and semi-structured interviews. Analyzing the legal framework, characterizing the fishing practice in STP, and considering the resource limitations of the GC, it appears that STP must maintain, or even, increase cooperation with other States and Organizations. The legal framework for fisheries must be revised, transposing the legal instruments, regional and international, against IUU fishing, having a clear definition of the concepts for better interpretation, and guaranteeing the legitimacy of the GC for the inspection of Fisheries. dc.description.abstractA pesca ilegal, não declarada e não regulamentada (Pesca INN), é uma ameaça que diminui o stock de peixe, um dos mais valiosos recursos para a economia e alimentação da população de São Tomé e Príncipe (STP). Pese embora a existência, em STP, de normativos legais e de uma Guarda Costeira (GC), a Pesca INN continua a estar presente. Este estudo visa analisar, com atenção as atuais circunstâncias, de que forma a GC pode contribuir para eliminar a Pesca INN, a ameaça que tira, anualmente, cerca de 1,5 mil milhões de dólares à região de Golfo da Guiné (RGG) onde STP está localizado. Para o efeito, foi aplicado um raciocínio indutivo, recorreu-se a uma estratégia de pesquisa qualitativa e foram realizadas, além da análise documental, entrevistas semiestruturadas. Analisando o enquadramento legal, caracterizando a prática atual da pesca em STP e tendo em consideração as limitações de recursos da GC, verifica-se que STP deve manter, ou mesmo incrementar a cooperação com outros Estados e Organizações. O quadro jurídico vigente das pescas deve ser revisto, transpondo os instrumentos legais, regionais e internacionais, contra a Pesca INN, por forma a obter uma definição clara dos conceitos para melhor interpretação e garantir a legitimidade da GC na fiscalização das Pescas.pt_PT
