O presente relatĂłrio Ă© o reflexo do estĂĄgio curricular que realizei no JuĂzo de ComĂ©rcio do Tribunal Judicial da Comarca de Lisboa, que teve a duração de 5 meses.
AlĂ©m de relatar sumariamente a minha experiĂȘncia enquanto estagiĂĄria na suprarreferida instituição, o tema deste relatĂłrio vai incidir sobre a anĂĄlise do incidente de qualificação da insolvĂȘncia, em especial, no que diz respeito ao Ăąmbito subjetivo do mesmo, isto Ă©, os sujeitos que podem ser afetados pela qualificação.
Sendo este incidente alvo de divergĂȘncias na doutrina e na jurisprudĂȘncia no que concerne Ă extensĂŁo do elenco de sujeitos que podem ser responsabilizados pela insolvĂȘncia culposa, procuro com este relatĂłrio explorar estas questĂ”es, tendo como referĂȘncia os casos com os quais me fui deparando no decorrer do estĂĄgio.
Com efeito, serĂŁo abordadas questĂ”es como a diferença na redação do n.Âș 1 do art. 186.Âș em comparação com o n.Âș 2, al. a) do art. 189.Âș do CIRE, se os propostos afetados se cingem apenas Ă s pessoas singulares ou se, pelo contrĂĄrio, podem incluir pessoas coletivas e, por Ășltimo, se os interesses que se pretendem tutelar com este incidente nĂŁo requerem uma previsĂŁo legal expressa da figura dos cĂșmplices. No conceito de cĂșmplices estĂŁo incluĂdos todos aqueles que tenham colaborado, com dolo ou culpa grave, com o devedor ou administradores para causar ou agravar a situação de insolvĂȘncia.
This report is a reflection of my five-month curricular internship at the Commercial Court of the Lisbon District Court. As well as giving a brief account of my experience as a trainee at the abovementioned institution, the subject of this report will focus on analyzing the insolvency qualification incident, especially with regard to its subjective scope, i.e. the subjects who may be affected by the qualification. As this incident is the subject of disagreements in doctrine and case law regarding the extent of the list of individuals who can be held liable for culpable insolvency, I intend to explore these issues in this report, with reference to the cases I came across during my internship. In fact, I will address issues such as the difference in the wording of Article 186.Âș n.Âș 1 compared to Article 189.Âș n.Âș 2 al. a) of the CIRE, whether the nature of the parties affected is limited to natural persons or whether, on the contrary, it can be combined with the nature of legal persons and, finally, whether the interests that this incident is intended to protect do not require an express legal provision for the figure of accomplices. The concept of accomplices includes all those who have collaborated, with intent or serious fault, with the debtor or administrators to cause or worsen the insolvency situation.
