Abstract

The main purposes of the execution of deprivation of liberty sentences are the social reintegration and the non-reiteration of the crime by the convicted. This report intends to depict the reality of the Court of Execution of Penalties, moreover through the study of its actions related to the granting or denial of parole. Therefore, it is outlined the procedure of the consideration to grant probation by the Court, highlighting the challenges and specificities faced by the magistrates, underlying the decision granting the two-thirds of the sentence mark.

A execução das penas privativas de liberdade tem como escopo principal a reinserção social e a não reiteração criminal do condenado. Com o presente relatório pretende retratar-se a realidade do Tribunal da Execução das Penas, sobretudo através do estudo da sua atuação no âmbito da concessão ou negação da liberdade condicional. Para tal, cumpre delinear o procedimento para apreciação da liberdade condicional realizado pelo tribunal, destacando os desafios e especificidades encontrados pelos magistrados, subjacentes à decisão concessiva no marco dos dois terços da pena.
