Contra-Terrorismo

Abstract

Due to our daily contact with terrorism, consequence of our professional duties in CT activity, as a criminal investigator, we have identified two circumstances that promote the incorrect analysis of the phenomenon in terms of public discourse: on the one hand, the poor comprehension of basic concepts and ideas regarding terrorism, rooted in sophism and prejudice, conveyed by opinion-makers, some with institutional responsibility; on the other hand, the misrepresentation of (some) legal foundations of the Internal Security and Justice systems, sometimes with law coverage, that only achieve to destabilize the CT response. In this context, and taking advantage of the academic opportunity, we decided to approach some issues that we think are essential in order to clarify this matter. Thus, under a dogmatic construction (qualitative dimension) in which we reason about the concept of terrorism, its preventive investigation, or the prevention of radicalization and violent extremism, among others, we have built a study in which we thrived to ascertain an approximated answer to the following question: which is the “ideal” model of a CT unit? To this effect, we have obtained the opinions of national and international CT experts, arising from their concrete experience, through questionnaires (quantitative dimension), still addressing relevant notions, as police and the articulation of those two above mentioned state systems. In doing so, confronting a proposal of an “ideal” CT unit with the obtained answers, starting with the Portuguese reality, but with projection capability to the realm of the “what should be”, we succeeded in presenting a set of characteristics and features that should be present in such unit. Fulfilling the methodologic demands, we believe that new knowledge was achieved, aiming to decision-making that improve the CT praxis, as intended by the applied and practice-oriented investigation.

Em virtude do nosso contacto diário com o terrorismo, consequência do desempenho profissional da actividade CT, enquanto investigador criminal, identificámos duas circunstâncias que concorrem para a incorrecta análise do fenómeno em termos da opinião pública: por um lado, a má compreensão de conceitos e ideias-base no âmbito do terrorismo, ancorada em sofismos e preconceitos, veiculados por opinion-makers, alguns com responsabilidade institucionais; por outro, o desvirtuar de (alguns) alicerces jurídicos dos sistemas de Segurança Interna e da Justiça, por vezes com cobertura legal, que apenas alcançam desestabilizar a resposta CT. Neste contexto, e aproveitando o ensejo académico, decidimos abordar algumas questões que reputamos essenciais clarificar nesta temática. Assim, sob uma construção dogmática (vertente qualitativa) em que discorremos sobre o conceito de terrorismo, a sua investigação preventiva, ou a prevenção da radicalização e do extremismo violento, entre outros temas, edificámos um estudo em que pretendemos apurar uma resposta aproximada à questão: qual o modelo “ideal” de uma unidade CT? Para este efeito, obtivemos as opiniões decorrentes da experiência concreta de especialistas CT nacionais e internacionais, através de questionários (vertente quantitativa), abordando ainda noções relevantes como a de polícia e a da articulação daqueles dois referidos sistemas estatais. Desta maneira, confrontando uma proposta de uma unidade CT “ideal” com as respostas obtidas, partindo da realidade portuguesa, mas com capacidade de extrapolação para o reino do “dever-ser”, logramos apresentar um conjunto de características e valências que deverão estar presentes em tal unidade. Cumprindo as exigências metodológicas, julgamos ter alcançado conhecimento inovador, visando uma tomada de decisão para a melhoria da praxis CT, como é intuito da investigação aplicada e orientada para a prática.
