To a better understanding it seems advisable to show, at a glance, the oil industry. These considerations allows the enhancement of the oil arbitration within its international and investment context; the existence of different kinds of arbitrations and the applicable legal frames enshrined in several international and national legal sources. In the aftermath, it seems suitable to tackle some problems and solutions dealt by the arbitrators when it comes to apply the rules to the merits of the dispute. Indeed it is a very difficult and delicate subject. At last, some conclusions will be pointed out. We are perfectly aware that factors related to the nature, difficulty of this issue and due time does not allow us to present an exhaustive treatment of the subject.
