Abstract

In the past decades, the border has shifted from being just the demarcation of physical space and the physical external border of Member States has gradually been transformed into a digital border. The proliferation of information systems controlling migration flows has reconfigured the way migration policy is managed in the Schengen Area. These systems are closely linked to the idea of Europe without internal borders, which culminated in compensatory measures aimed at ensuring the internal security of its nationals and controlling the displacement of thirdcountry nationals. The EU has been creating ever more comprehensive large-scale databases and using ever more intrusive technologies, turning its territory into a technological fortress, which will be more strongly formed with the interoperability of systems. The scenario envisioned for the coming years is that every third-country national applying for entry or entering the Schengen Area will have their personal data collected and stored by at least one database, with possible sharing when systems are interoperable. Thus, challenges in establishing a fair balance between the sovereign power of States and the fundamental rights of TCN are a point of important concern. We noticed that the right to privacy is a fundamental right that is being infringed with the growing wave of the use of technology in the relations of the State and individuals, with important decisions of the European Courts. Nas últimas décadas, a fronteira deixou de ser apenas a demarcação do espaço físico e a fronteira externa física dos Estados-Membros foi gradualmente se transformando em uma fronteira digital. A proliferação dos sistemas de informação de controle dos fluxos migratórios reconfigurou a forma como a política migratória é gerida no espaço Schengen. Esses sistemas estão intimamente ligados à ideia de Europa sem fronteiras internas, que culminaram em medidas compensatórias, visando garantir a segurança interna dos seus nacionais e controlar o deslocamento de nacionais de países terceiros. A UE foi criando bases de dados em larga escala cada vez mais abrangentes e utilizando tecnologias cada vez mais intrusivas, transformando seu território em uma fortaleza tecnológica, que estará mais fortemente formada com a interoperabilidade dos sistemas. O cenário que se vislumbra para os próximos anos é um em que todo nacional de país terceiro que solicite entrada ou que ingresse no espaço Schengen terá seus dados pessoais coletados, processados e armazenados por ao menos uma base de dados, com possível partilha quando os sistemas estiverem interoperáveis. Desta feita, desafios em se estabelecer um justo equilíbrio entre o poder soberano dos Estados e os direitos fundamentais dos NPTs são um ponto de importante preocupação. Verificamos que o direito à privacidade é um direito fundamental que está sendo infringido com a crescente onda do emprego da tecnologia nas relações do Estado e dos indivíduos, com importantes decisões do Tribunal Europeu de Direitos Humanos e Tribunal de Justiça da União Europeia.
