As reservas de surfe e a conservação da biodiversidade

Abstract

The ocean performs essential functions for life on Earth and has had its use and exploitation intensified over time so that efforts to conserve it are urgent. Surfing is one of the fastest growing sports in the world and, due to its direct connection with nature and the ocean, it plays an essential role in raising awareness of the need for conservation. Around the world, several innovative models of nature conservation have emerged and it is also up to the Law to investigate and frame them, whenever possible. The present work aims, through the methodology of literature review and case studies, to understand if the existing tools for the protection of surf breaks can be recognized as in situ conservation tools and, consequently, count towards the achievement of the related international goals. It was concluded that, among the two existing conservation tools, Protected Areas and Other Effective Area-Based Conservation Measures (OECMs), the second is presented as the most adequate model for the protection of surf breaks.

O oceano desempenha funções essenciais para a vida na Terra e tem tido seu uso e exploração intensificado ao decorrer do tempo, de forma que os esforços para sua conservação possuem caráter de urgência. O surfe é um dos esportes que mais cresce no mundo e, por conta da ligação direta com a natureza e o oceano, desempenha um papel essencial na conscientização sobre a necessidade de conservação. Ao redor do mundo diversos modelos inovadores de conservação da natureza têm surgido e cabe também ao Direito investigá-las e enquadrá-las, sempre que possível. O presente trabalho visa, por meio da metodologia de revisão bibliográfica e estudos de caso, compreender se as ferramentas existentes para a proteção dos surf breaks podem ser reconhecidas como ferramentas de conservação in situ e, consequentemente, passar a contar para o alcance das metas internacionais relacionadas. Concluiu-se que, dentre as duas ferramentas de conservação existentes, as Áreas Protegidas e as Other Effective Area-Based Conservation Measures (OECMs), a segunda apresenta-se como o modelo mais adequado para a proteção de surf breaks.
