RESUMO - À luz dos novos avanços ocorridos nos últimos anos na
área do tabagismo que têm demonstrado a importância
cada vez maior deste fenómeno no aumento do peso global
da doença presente em todos os países, torna-se
necessária a revisão constante das nossas políticas de
saúde nesta área, bem como uma especial atenção à
adaptação da legislação a esta realidade. Actualmente,
não está apenas em causa a saúde daqueles que fumam,
mas também de todos os que convivem de perto com um
fumador. O fumador passivo, exposto à poluição tabágica
ambiental (PTA) provocada pelos fumadores, encontra-se
exposto a uma série de doenças potenciais que cada vez
mais necessitam de ser prevenidas. Neste quadro, cabe à
sociedade proteger a saúde dos seus cidadãos através de
uma legislação que proteja os não fumadores, ao mesmo
tempo que respeita a opção daqueles que fumam.
Assim, este artigo procurará fazer uma revisão de evidências
científicas, através da avaliação de três estudos
existentes, que contribua, de forma efectiva, para uma
tomada de decisão sobre a proibição de fumar em determinados
locais e outras medidas de suporte necessárias
para a possível protecção da saúde dos indivíduos expostos
à PTA. No final, o autor propõe uma remodelação da
legislação actual na área do tabagismo passivo de forma
a reunir todas as leis já existentes e proporcionar uma
visão mais abrangente sobre a actuação da sociedade
nesta área.
ABSTRACT - Recent advances on tobacco use and its impact in the increasing share of disease burden in all countries demand a constant review of health politics and special attention to the adaptation of the existent legislation to this reality. Today, those in danger are not only those who smoke but also those who are closely in touch with a smoker. The passive smoker exposed to ETS is exposed to many potential diseases that need to be prevented. Therefore, it is up to society to protect the health of their citizens through the application of a legislation which protects non-smokers and that respects the options of those who smoke. In this article, the author reviews the existing evidences presented in two major studies that can contribute, in an effective way, to a decision about either prohibiting smoking in certain places or taking other needed measures to protect those exposed to ETS. At the end, the author proposes changes in the actual law regarding passive smoking, gathering all the existing laws and presenting a broader vision of the role of society as a whole in this field.
