| dc.description.abstract | O objetivo principal deste texto é provar a urgência e necessidade de padronizar a legítima atividade de inteligência do Poder Judiciário brasileiro, de forma independente. A tese demonstra que a doutrina e política nacional específicas são um importante e imensurável instrumento de segurança para salvaguardar a atuação autônoma da atividade de inteligência dentro do Poder Judiciário nacional. A legitimidade dessa atividade tem fundamento na Constituição da República Federativa do Brasil e normas infraconstitucionais para a proteção dos seus integrantes e de sua função jurisdicional, em face das diversas e crescentes ameaças que estes vêm sofrendo. No estudo, foram analisados os conceitos e fundamentos dos serviços de inteligência, bem como a necessária e possível implantação no Poder Judiciário, com base na normatização elaborada pelo Conselho Nacional de Justiça e seguida pelos tribunais superiores, federais e estaduais, tendo por lastro a independência do Poder Judiciário. | pt_PT |
| dc.description.abstract | The main objective of this text is to prove the urgency and need to standardize the legitimate intelligence activity of the Brazilian Judiciary, with independence from the other branches of the Republic. The thesis demonstrates that specific national doctrine and policy are an important and immeasurable security instrument to safeguard the autonomous performance of the intelligence activity within the national Judiciary. The legitimacy of this activity is based on the Constitution of the Federative Republic of Brazil and infraconstitutional rules for the protection of its members and their jurisdictional function, in the face of the diverse and growing threats that they have been suffering. In the study, the concepts and fundamentals of intelligence services were analyzed, as well as the necessary and possible implementation in the Judiciary, based on the norms prepared by the National Council of Justice and followed by the superior, federal and state courts, always with independence as the basis of the Judiciary. | pt_PT |
