| dc.description.abstract | O terrorismo é ameaça tangível aos Estados. Seu enfrentamento suscita importantes questões securitárias e jurídicas. De um lado, a necessidade de efetividade na prevenção e na repressão do fenômeno. De outro, a indissociável observância de direitos fundamentais, sem a qual os pilares do Estado de Direito democrático podem ruir. Portugal e Brasil têm pontos em comum acerca do tema: enfrentaram o terrorismo interno durante períodos ditatoriais e são países pouco afetados pelo terrorismo de matriz religiosa. Essa investigação pretende analisar o modelo de contraterrorismo admitido pelas Constituições desses países, detectando constrangimentos — medidas que podem ser implementadas com parcimônia para garantir eficácia e eficiência na prevenção e repressão ao terrorismo — e estabelecendo limites — linhas que não devem ser ultrapassadas por significarem atropelo ao Estado de Direito democrático. | pt_PT |
| dc.description.abstract | Terrorism is a tangible threat to states. Dealing with it raises important security and legal issues. On the one hand, there is the need for effective prevention and repression of the phenomenon. On the other, the inseparable observance of fundamental rights, without which the pillars of the democratic rule of law could collapse. Portugal and Brazil have points in common on the subject: they faced internal terrorism during dictatorial periods and are countries that are little affected by religious terrorism. This research aims to analyze the counter-terrorism model allowed by the Constitutions of these countries, detecting constraints — measures that can be implemented sparingly to ensure effectiveness and efficiency in preventing and repressing terrorism — and establishing limits — lines that should not be crossed because they would mean trampling on the democratic rule of law. | pt_PT |
