Pena privativa da liberdade

Abstract

The present dissertation intends to be a questioning of the status quo that prevails in the legal prevision of the main sentences, focusing exclusively on the analysis of the custodial sentences. Starting with some historical scrutiny of the prison, it proceeds with an analysis of the purpose of sentencing, stately directed to the answer to the question of knowing in light of which of the theoretical hypotheses the application of a prison sentence is (eventually) conceived. The work continues with the analysis of the prison problem, denouncing the disillusionment that the consecration of the institute means in the modern Criminal Law, scalping the inexpediency of its application, arriving at a suggestion of a solution to the problem presented, as if it were a legal-humanistic equation.

A presente dissertação assume-se como uma interrogação ao status quo que impera na previsão legal das penas principais, debruçando-se exclusivamente sobre a análise da pena privativa da liberdade. Partindo de algum escrutínio histórico do instituto da prisão, prossegue com uma análise da teoria da pena, declaradamente orientada para a resposta à questão de saber à luz de qual das hipóteses teóricas (eventualmente) se concebe a aplicação de uma pena de prisão. O trabalho avança com a análise do problema carcerário, denunciando a desilusão que a consagração do instituto significa no hodierno Direito Penal, dissecando a inoportunidade da sua aplicação, vindo a desaguar numa proposta de solução ao problema apresentado, qual equação jurídico-humanista.
