A polícia líquida

Abstract

Starting with the administrative task of security and its international link, we analyse the legal figure of Police - as an activity, as an organisation and as a power – which was consolidated in the heyday of the Welfare State, without forgetting as it got there, due to different types and forms of State and different legal systems. This perspective is an important leverage point for understanding how the Police reconfigure itself in late modernity, in view of the emerging social, cultural and political circumstances that influence the State and the administration. Current themes, such as the features of post-modernity, the complex and invisible society, individuality and fear, privatization, the new threats, the risk society, the regulatory State, the security governance and changes in Economics and Law, are at the forefront of the reasons that drive the metamorphoses of the Police. The world changes and the Police also changes. Central concepts for understanding the Police, like danger, prevention, monopoly of internal security or multiple Police institutions, are being complemented by others, such as risk, precaution, security governance or national police. Consolidated ideas, such as mechanical, bureaucratic structures different staff legal frameworks, technical and tactical material acts or administrative and material acts, are being surpassed by others, such as the professional bureaucratic structures, basic police personal condition, managerial and strategic acts, cooperation and consultation or informal actions. Sometimes, war and Criminal Law threaten to make the Police and Police Law disappear. It is acknowledged that, being impossible to prevent the arrival of the future, it is necessary to rewrite the Police, by redefining it and by imposing limits to it, namely the pursuit of the public interest of security and the achievement of the fundamental rights of citizens.

Arrancando da tarefa administrativa da segurança e do seu vínculo internacional, analisa-se o instituto jurídico da Polícia – como actividade, organização e poder – que se consolidou no auge do Estado social, sem esquecer como aí se chegou, em razão dos diferentes tipos e formas de Estado e dos diferentes sistemas de Direito. Esta perspectiva é um importante ponto de alavancagem para a compreensão de como a Polícia se está a reconfigurar na modernidade tardia, atentas as emergentes circunstâncias sociais, culturais e políticas que influenciam o Estado e a administração. Temas da actualidade, como as características da pós-modernidade, a sociedade complexa e invisível, a individualidade e o medo, a privatização, as novas ameaças, a sociedade do risco, o Estado regulador, a governance da segurança e as mutações da Economia e do Direito, estão na linha da frente dos motivos que impulsionam as metamorfoses da Polícia. O mundo muda e a Polícia muda também. Conceitos centrais na compreensão da Polícia, como os de perigo, de prevenção, de monopólio da segurança interna ou de múltiplos corpos de polícia, estão a ser complementados por outros, como os de risco, de precaução, de governance da segurança ou o de polícia nacional. Ideias consolidadas, como as de estruturas burocráticas mecânicas, de múltiplos regimes jurídicos do pessoal, de actos materiais técnicos e tácticos ou de actos administrativos e materiais, estão a ser superadas por outras, como as de estruturas burocráticas profissionais, de condição pessoal policial de base, de actos gestionários e estratégicos, de cooperação e concertação ou de actuações informais. Por vezes a guerra e o Direto Penal ameaçam fazer desaparecer a Polícia e o Direito Policial. Reconhece-se que, não se podendo impedir a chegada do futuro, é necessário reescrever a Polícia, redefinindo-a, e impor-lhe limites, entre os quais se destacam a prossecução do interesse público da segurança e a concretização dos direitos fundamentais dos cidadãos.
