A justiciabilidade dos direitos económicos, sociais e culturais, em particular do direito à saúde

Abstract

The current international system of human rights protection establishes different regimes for civil and political rights and for economic, social and cultural rights. The latter have been relegated to a secondary role and have received fewer protection than civil and political rights. A consequence of this differentiation has also been the questioning of the justiciability of economic, social and cultural rights. At first, economic, social and cultural rights, and in particular the right to health, are focused, namely their content and the States’ duties in what concerns their fulfilment and protection. The international, regional and national mechanisms of protection are identified, including those that apply to human rights in general and to economic, social and cultural rights in particular, in order to understand if, also in this regard, there is a differentiation between civil and political rights and economic, social and cultural rights. Subsequently, the main criticisms regarding economic, social and cultural rights, which substantiate the different regimes, are exposed, as well as the opinions that oppose to them, with the aim of understanding if this differentiation is justified. The same approach is adopted in what concerns the justiciability of economic, social and cultural rights, with the identification of the opinions for and against the review by available courts and quasi-judicial bodies in case of violation of these rights. Finally, decisions of judicial and quasi-judicial bodies related to economic, social and cultural rights and, whenever possible, to the right to health, are described, namely decisions from various regions of the globe and including decisions from developed and developing countries, to illustrate with concrete cases the evolution of the justiciability of these rights that has happened throughout the years at the international, regional and national levels.

O sistema de proteção internacional dos direitos humanos atual consagrou um regime diferente para os direitos civis e políticos e para os direitos económicos, sociais e culturais, tendo estes últimos sido relegados para segundo plano e recebido menor proteção do que os direitos civis e políticos. Desta diferenciação decorreu igualmente o questionamento da justiciabilidade dos direitos económicos, sociais e culturais. São inicialmente focados os direitos económicos, sociais e culturais, e o direito à saúde em particular, o seu conteúdo e as obrigações dos Estados no que respeita à sua realização e proteção. Identificam-se os mecanismos internacionais, regionais e nacionais de proteção dos direitos humanos em geral e dos direitos económicos, sociais e culturais em particular, para se perceber se também neste âmbito existe uma diferenciação entre os direitos civis e políticos e os direitos económicos, sociais e culturais. Seguidamente, são identificadas as principais críticas relativas aos direitos económicos, sociais e culturais, nas quais se fundamenta a diferença de regimes, bem como os argumentos que as contrariam, com o objetivo de perceber se esta diferenciação é justificada. A mesma abordagem é adotada em relação à justiciabilidade dos direitos económicos, sociais e culturais, com a identificação dos argumentos contra e a favor do recurso aos tribunais e aos órgãos quase-judiciais disponíveis em caso de violação dos direitos. Por último, identificam-se decisões dos órgãos judiciais e quase-judiciais relativas aos direitos económicos, sociais e culturais e, sempre que possível, ao direito à saúde, de várias regiões do globo e incluindo países desenvolvidos e em vias de desenvolvimento, com o intuito de ilustrar com casos concretos a evolução da justiciabilidade destes direitos que tem ocorrido ao longo dos anos aos níveis internacional, regional e nacional.
