Relatório de Estágio no Juízo Criminal de Loures: O infanticídio e a sua Invisibilidade Jurídica

Abstract

O presente relatório é fruto de quatro meses de estágio realizado no Juízo Central Criminal de Loures, onde diariamente acompanhei o trabalho do Tribunal Coletivo, supervisionada pela Dra. Juiz Ana Marques Proença. Este relatório está estruturado em duas partes. A primeira parte apresenta a caracterização do tribunal e das atividades desenvolvidas, incluindo a análise de processos, o acompanhamento das diligências de julgamento e a exposição dos três casos mais significativos observados. Na segunda parte, esta dissertação apresenta um trabalho de investigação centrado na figura do infanticídio, e na sua aplicabilidade prática. O contexto histórico, e a sua compreensão legislativa serão abordados numa breve secção de modo a contextualizar a construção normativa deste delito. A complexidade de delimitação do art.º 136 do Código Penal, os desafios interpretativos enfrentados pelos tribunais, juntamente com as dificuldades práticas na aplicação efetiva do delito, serão igualmente analisados. Posteriormente serão discutidos os critérios jurídicos e doutrinários em que se fundamenta o privilégio do delito em causa, pelo que reservo os últimos capítulos para proceder a uma reflexão crítica da viabilidade de reconfiguração do crime de infanticídio no âmbito do homicídio privilegiado, explorando os fundamentos normativos deste último para aferir a sua adequação ao enquadramento do primeiro.

The present report is the result of a four-month internship at the Central Criminal Court of Loures, where I accompanied the work of the Collective Court on a daily basis, under the supervision of Judge Ana Marques Proença. This report is structured in two parts. The first part presents the characterization of the court and the activities carried out, including the analysis of cases, monitoring of trial proceedings, and the presentation of the three most significant cases observed. In the second part, this dissertation presents a research study focused on the crime of infanticide and its practical applicability. The historical context and legislative understanding will be addressed in a brief section to contextualize the normative construction of this crime. The complexity of defining Article 136 of the Penal Code, the interpretative challenges faced by courts, along with the practical difficulties in the effective application of the crime, will also be analyzed. Subsequently, the legal and doctrinal criteria underlying the privilege of the crime in question will be discussed, and I reserve the final chapters to critically reflect on the feasibility of reconfiguring the crime of infanticide within the framework of privileged homicide, exploring the normative foundations of the latter to assess its adequacy to the framework of the former.
