Curricular internship report at the embassy of Portugal in Prague. "Assessing Czech asylum policies in the current global geopolitics: the activation of the temporary protection directive and the institutionalization of inequality."

Abstract

O presente relatório expressa os resultados de um estágio curricular realizado no âmbito da componente não lectiva do Mestrado em Direito e Economia do Mar: Governação dos Oceanos da NOVA School of Law. O estágio foi realizado de acordo com o Programa de Estágios Curriculares do Ministério dos Negócios Estrangeiros (PECMNE), de forma presencial, entre outubro de 2022 e abril de 2023 na Embaixada de Portugal em Praga, um serviço periférico do Ministério dos Negócios Estrangeiros. Nesta exposição, procurou-se integrar os conhecimentos teóricos adquiridos durante a componente lectiva do Mestrado em Direito com a experiência prática adquirida durante o estágio e o desempenho de funções profissionais relevantes. Assim, na parte I do relatório, serão exploradas as relações diplomáticas entre Portugal e a Chéquia, seguindo-se uma análise do contexto político atual na Chéquia e uma exposição do funcionamento e das responsabilidades assumidas na Embaixada de Portugal em Praga durante o estágio. Na parte II, irá proceder-se à análise do sistema de asilo checo, explorando não só o quadro legal nacional aplicável, mas também o ordenamento internacional e europeu a que a Chéquia está vinculada, com especial atenção despendida à ativação da Diretiva de Proteção Temporária. Isto permitirá a contextualização necessária para a secção de discussão do relatório, que tem como objetivo fazer uma análise comparativa entre as respostas da Chéquia à chegada de requerentes de asilo não europeus e as suas respostas à chegada de requerentes de asilo vindos da Ucrânia, procurando determinar se existem dois pesos e duas medidas nas políticas de migração e asilo no país. Por último, as condutas da Chéquia serão contextualizadas no quadro europeu, tendo em conta a sua conformidade com o Direito Internacional e os próprios princípios da União.

This report expresses the results of a curricular internship carried out as part of the non-teaching component of the Master's Degree in Law and Economics of the Sea:Ocean Governance at NOVA School of Law. The internship was carried out in accordance with the Curricular Internship Program of the Ministry of Foreign Affairs (PECMNE), in person, between October 2022 and April 2023 at the Portuguese Embassy in Prague, a peripheral service of the Ministry of Foreign Affairs. In this exposition, the goal was to integrate the theoretical knowledge acquired during the teaching component of the Master's Degree in Law with the practical experience gained during the internship and the execution of relevant professional duties. Therefore, in part I of the report, the diplomatic relations between Portugal and Czechia will be explored, followed by an analysis of the current political situation in Czechia and an in-depth understanding of the functioning and responsibilities undertaken at the Embassy of Portugal in Prague during the internship. In part II, the analysis will proceed to the examination of Czechia’s asylum system, exploring not only the national legal framework applicable but also the international and European legal systems to which Czechia is bond to, with special attention given to the activation of the Temporary Protection Directive. This will allow the necessary contextualization for the discussion section of the report, which aims to make a comparative analysis between Czechia’s responses to the arrival of non-European asylum seekers and its responses to the displacement crisis in Ukraine, determining whether double standards are at play in Czechia’s migration and asylum policies. Lastly, Czechia’s conducts will be contextualized within the broader European framework, taking into account compliance with International Law and the Union’s own Principles.
