Das Ações Encobertas: Contributos para uma Teoria Geral

Abstract

As ações encobertas são uma técnica especial de investigação utilizada principalmente na investigação às formas de criminalidade mais organizada e violenta. No entanto, é uma técnica revestida de alguma opacidade, principalmente com o intuito de garantir a segurança dos intervenientes nas operações, tendo em conta a criminalidade que investiga. Talvez por essa razão, é uma técnica rodeada de muita polémica e controvérsia, com constantes dúvidas relativas à sua aplicação. Pelas razões apontadas, o principal objetivo desta tese é o de clarificar a atuação do agente encoberto; a legalidade da sua atuação, a atenção à sua formação específica, o apoio logístico e psicológico de que este deve usufruir, além dos princípios éticos e morais que devem presidir a toda a sua atuação. Para tal, o estudo foi dividido em três partes, nas quais se procurou analisar todo o circunstancialismo relativo às ações encobertas e ao agente encoberto. Assim, na primeira parte analisaram-se alguns fatores históricos julgados relevantes, que nos levassem à origem do agente encoberto. Recuou-se à Antiguidade para recuperar a origem desta figura, fazendo-se um paralelismo entre o espião e o agente encoberto. A evolução social levou à separação destas duas figuras, quando a realidade policial atingiu a maturidade investigativa para passar a utilizar o agente encoberto como ferramenta. Na segunda parte, procurou clarificar-se a atuação do agente encoberto, principalmente no ordenamento jurídico português, recorrendo para tal a um estudo comparativo entre as legislações de vários países, procurando-se alguma amplitude e utilizando para isso diferentes paragens e raízes legislativas. Para complementar esta análise legislativa, realizou-se uma pesquisa à jurisprudência nacional e europeia, o que nos trouxe uma visão mais alargada relativamente ao tema. Para terminar, na terceira parte, procurou abordar-se os princípios éticos e morais que devem nortear as ações encobertas, tendo-se estudado vários casos internacionais, que levaram a colocar em causa estes princípios. Outro fator a ter em conta, e ao qual se deu relevância, foi o apoio logístico e psicológico devido ao agente encoberto durante as operações, procurando fazer esquecer as teorias do lobo solitário trazidas pela literatura e cinematografia ocidentais, demonstrando que a utilização da técnica é maioritariamente um trabalho de equipa, com o objetivo de preservar a técnica, respeitando a legislação vigente, mas principalmente a segurança dos intervenientes.

The undercover operations are a special technic of investigation used mostly to investigate organized and violent types of criminality. It is a rather opaque technic, mainly with the objective of assuring the safety of the officers involved in the operations that investigate this king of criminality. Probably this is the reason why it is surrounded by controversy and discussion that arouse doubts about its application. For these reasons, the main goal of this thesis is to clarify the performance of the undercover officer; the legality of the performance, the specific training required, the logistic and psychological support that must be given and the moral and ethical principles that must preside during all operation. The study was divided in three parts, in order to analyze all of the specificities related to the undercover operations and the undercover officer. In the first part, relevant historical facts were analyzed, and they led us to the undercover officer’s origin. We regressed to antiquity to recover the origin of this figure, establishing a parallelism between the spy and the undercover officer. The social evolution led to the separation of these two figures, when the police reality reached its investigative maturity and began to use the undercover officer as a tool. In the second part, we tried to clarify the performance of the undercover officer, according to Portuguese legal system. We did a comparative study between several countries’ legislations, looking for some amplitude and different legislative roots. To complement this legislative analysis, we researched the national and European jurisprudence, that brought us a wider vision of this theme. In the third and last part, we approached the moral and ethical principles that must head the undercover operations and we have studied several international cases that challenged these principles. Other major factor, highlighted in this thesis, is the logistic and psychological support due to the undercover officer during undercover operations, reducing the occidental cinema and literature lone wolf theories to dust, demonstrating that this is a team work job, with the goals of preserving the technic, obeying the current legislation and mostly assuring the safety of the operators.
