Relatório de Estágio no Juízo de Família e Menores no Tribunal Judicial da Comarca de Lisboa - Alienação Parental: Mecanismos de Prevenção e Repressão no Ordenamento Jurídico Português

Abstract

O divórcio ou a separação conjugal conduzem, muitas vezes, a um conflito parental acentuado (podendo envolver também a família alargada), por os progenitores não conseguirem gerir as suas emoções de angústia, desilusão e de luto perante o sucedido. Envoltos nesse conflito, muitas vezes, utilizam os filhos como “arma de arremesso”, adotando um conjunto de comportamentos que visam instigar a antipatia, denegrir a imagem e apartar o outro progenitor da vida da criança. Este fenómeno é denominado de Alienação Parental. Esta dinâmica, além de afetar gravemente a relação paternofilial entre a criança e o progenitor alienado, viola o superior interesse da criança e o seu direito à convivência familiar. Paralelamente, tem também repercussões nefastas no desenvolvimento psicoemocional da criança alienada. Por esta ser uma forma de violência familiar, que não deve ser menosprezada, os Estados têm-se debatido sobre quais as respostas legislativas a implementar para mitigar este flagelo social. A presente dissertação visa caracterizar o fenómeno social da Alienação Parental, explicando o que abarca este conceito, apresentar as suas principais controvérsias e as consequências psicológicas e emocionais que a sua prática acarreta para a criança. De seguida, debruçar-nos-emos sobre os seus alicerces jurídicos, explanando quais direitos são violados com a perpretação dos comportamentos alienantes, assim como faremos uma breve análise jurisprudencial sobre o tema. No último capítulo, exploraremos as respostas legislativas presentes na nossa ordem jurídica, quer no domínio cível quer no domínio criminal, pronunciando-nos sobre a sua aplicação e eficácia, e refletiremos sobre a necessidade de legislação específica que tipifique e regulamente este fenómeno.

Divorce or marital separation often leads to severe parental conflict (which can also involve the extended family), as the parents are unable to manage their emotions of anguish, disappointment and grief at what has happened. Involved in this conflict, they often use their children as a ‘weapon’, adopting a set of behaviours aimed at instigating antipathy, denigrating image and distancing the other parent from the child's life. This phenomenon is called Parental Alienation. Besides seriously affecting the relationship between the child and the alienated parent, this dynamic also violates the best interest of the child and their right to family life. In addition, it also has harmful repercussions on the psychological and emotional development of the alienated child. As this is a form of family violence that should not be overlooked, States have been debating which legislative responses should be implemented to mitigate this social scourge. This dissertation aims to characterise the social phenomenon of Parental Alienation, explaining what this concept includes, present the main controversies and psychological and emotional consequences that its practice has for the child. Thereafter, we will look at its legal foundations, explaining which rights are violated by alienating behaviour, and we will also briefly analyse case law on the subject. In the last chapter, we will explore the existing legal mechanisms in our legal system, both in the civil and criminal fields, commenting on their application and effectiveness, and we will reflect on the need for specific legislation that typifies and regulates this phenomenon.
