An in-depth critical analysis on the AI Act and the risk-based approach - does it deliver on its promise? Case study: AI-powered law enforcement and predictive policing future in a post AI Act Europe

Abstract

This research explores the issue of the use of PP technology in EU territory and the regulative position taken by the AIA in this regard. Chapter 1 constitutes and introduction on the relevant concepts, already existing AI governing frameworks, the research methodology, the impact of AI to everyday life, the research question posed and the importance of said research. Chapter 2 introduces one of the main concepts of the thesis, Predictive Policing, provides for the theorical background necessary to understand it and the typologies currently in use. Chapter 3 analyses the AI act in its current final form and its relevant dispositions, Chapter 4 presents the discussion of whether the AIA has provided for a sufficient and strong protection of the fundamental rights of those affected by PP.

Esta investigação explora a questão da utilização da tecnologia de PP no território da UE e a posição reguladora adoptada pela AIA a este respeito. O Capítulo 1 constitui uma introdução sobre os conceitos relevantes, os quadros regulamentares de IA já existentes, a metodologia de investigação, o impacto da IA na vida quotidiana, a questão de investigação colocada e a importância da referida investigação. O capítulo 2 apresenta um dos principais conceitos da tese, o policiamento preditivo, fornece o enquadramento teórico necessário para o compreender e as tipologias atualmente em uso. O capítulo 3 analisa a lei da IA na sua forma final atual e as suas disposições relevantes. O capítulo 4 apresenta a discussão sobre se o AIA proporcionou uma proteção suficiente e forte dos direitos fundamentais das pessoas afectadas pelo PP.
