Direito ao trabalho dos requerentes ou beneficiários de proteção internacional em Portugal:

Abstract

The purpose of this report was to analyse access to the labour market by applicants or beneficiaries of international protection (RBPI) in Portugal. Within the 2nd year of the Master's degree in International and European Law at “Universidade Nova de Lisboa”, a five-month curricular internship was carried out at CRESCER, an organization included in the network of institutions that support RBPI in Portugal. The applicable law to RBPI is in accordance with the international and European legal sources, covering fundamental areas as health, education, housing, or work, essential for their integration in the host country. In this study, an analysis is conducted on the pertinent legal instruments designed to safeguard individuals, particularly those classified as RBPI, at the international, European, and national levels. Topics such as the historical evolution of individual protection in the context of International Law, the normative framework relating to asylum law at an international level, and the political-legal context of asylum in the European Union are covered. A description of the legal framework applicable in Portugal is presented, with an emphasis on the rights of RBPI regarding access to the labour market in Portugal. The Right to work is one of the fundamental economic rights recognized in our Constitution, and its promotion is intrinsically connected to respect for human dignity. Indicators on migration flows in Portugal and Europe are presented, especially from 2015 onwards, focusing on indicators relevant to the integration of migrants, and in particular RBPI in the labour market. Finally, within the scope of the activities carried out during the curricular internship at CRESCER, a study is presented aimed at the RBPI beneficiaries of this association with the objective of better understanding their insertion into the labour market in our country.

O presente relatório teve como objetivo analisar o acesso ao mercado de trabalho por parte de requerentes ou beneficiários de proteção internacional (RBPI) em Portugal. Inserido no 2º ano do curso de Mestrado em Direito Internacional e Europeu da Universidade Nova de Lisboa, foi realizado um estágio curricular de cinco meses na CRESCER, uma organização inserida na rede de instituições que apoiam RBPI em Portugal. O Direito aplicável aos RBPI está alinhado com a normativa internacional e europeia, abrangendo áreas tão fundamentais como a saúde, a educação, a habitação, ou o trabalho, essenciais para a sua integração no país de acolhimento. Neste trabalho, é realizada uma análise dos instrumentos legais relevantes para a proteção do indivíduo, especialmente quanto aos RBPI, a nível internacional, europeu e nacional. Abordam-se temas como a evolução histórica da proteção do indivíduo no contexto do Direito Internacional, o quadro normativo relativo ao Direito de Asilo a nível Internacional, o contexto político-jurídico do asilo na União Europeia. Apresenta-se uma descrição do enquadramento legal aplicável em Portugal com ênfase aos direitos dos RBPI no que diz respeito ao acesso ao mercado de trabalho em Portugal. O Direito ao trabalho é um dos direitos económicos fundamentais reconhecidos na nossa Constituição, e a sua promoção está intrinsecamente ligada ao respeito pela dignidade humana. Apresentam-se indicadores sobre os fluxos migratórios em Portugal e na Europa, especialmente a partir de 2015 com foco nos indicadores relevantes para a integração de migrantes, e em particular de RBPI no mercado de trabalho. Por fim, no âmbito das atividades realizadas durante o estágio curricular na CRESCER, apresenta-se um estudo direcionado a beneficiários RBPI desta associação com o objetivo de compreender melhor a sua inserção no mercado de trabalho no nosso país.
