O sistema de acolhimento de crianças e jovens em Portugal

Abstract

When we talk about Children's Rights, we are talking about their right to achieve the defense and promotion of their rights and to see their physical and psychological well-being protected. So that we can truly work in this direction, we inevitably have to create space for other social and human sciences, which can help us in identifying and better understanding the interests of children and young people. Therefore, for a correct and broad understanding of this issue, we not only have to resort to Law, but also to other areas of knowledge, such as the scientific areas of psychology, child psychiatry, education and sociology, as will be evident in the throughout this work. In this sense, the objective of my thesis will be to study the rights of children and young people at an international and national level and the Portuguese foster system in order to be able to propose solutions to problems such as the lack of foster families, the weak stimulation of foster care families in our society, as well as identifying and trying to minimize the structural problems of foster homes, with regard to their own functioning and human resources, recognizing the consequences they have on the school life of the sheltered minors and identifying the support provided to young people during and after of their stay, with an emphasis on their autonomy. For this purpose, I intend not only to comment on the legislation, but also on its practical application, to analyze various studies on the indicated topics and, at the same time, compare reception systems in other countries, and also share what some professionals linked to this area suggest and try to implement on the day to day to improve the reality of these children and young people.

Quando falamos no Direito das Crianças falamos no direito que estas têm de alcançarem a defesa e a promoção dos seus direitos e verem o seu bem-estar físico e psíquico protegidos. Para que, verdadeiramente, possamos trabalhar nesse sentido temos inevitavelmente de criar espaço para outras ciências sociais e humanas, que nos possam auxiliar na identificação e melhor compreensão dos interesses das crianças e dos jovens. Assim sendo, para uma correta e ampla compreensão desta temática, temos necessariamente não só de recorrer ao Direito, como a outras áreas de conhecimento, tais como as áreas científicas da psicologia, da pedopsiquiatria, da educação e da sociologia, como será patente ao longo deste trabalho. Neste sentido, o objetivo da minha tese será estudar os direitos das crianças e jovens a nível internacional e nacional e o sistema de acolhimento português de modo a conseguir propor soluções para problemas como a falta de famílias de acolhimento, a fraca estimulação do acolhimento familiar na nossa sociedade, bem como identificar e tentar minimizar os problemas estruturais das casas de acolhimento, no que diz respeito ao seu próprio funcionamento e recursos humanos, reconhecer as consequências que provocam na vida escolar do menores acolhidos e identificar os apoios prestados aos jovens durante e depois do seu acolhimento, com enfâse na sua autonomização. Para isto pretendo não só comentar a legislação, como a sua aplicação prática, analisar vários estudos sobre os temas indicados e simultaneamente comparar sistemas de acolhimento de outros países, e ainda, partilhar o que alguns profissionais ligados a esta área sugerem e tentam implementar no dia a dia para melhorar realidade destas crianças e jovens.
