A evolução dos Direitos das Crianças na família

Abstract

The experience I had during the 6 months of my curricular internship in the Family and Minors Judicial Court of Mafra, changed and broadened my perspective regarding the children, their rights and the ways that exist to guarantee their effectiveness. However, a long road lies ahead. The evolution of the Rights of the Child in the family has been neither homogenous nor peaceful, and it is strongly marked by attempts, many of them erroneous, to consecrate those who, for us, should be the guiding principles of this discipline. The constant mutation in the field of Family Law, which directly affects the Rights of the child, is notorious, although this is, in our opinion, a branch of law that is autonomous from it. The changes at social, family and individual level, combined with the growing Europeanization and internationalization, have brought new legal challenges that place the child in situations of uncertainty to its development. Within these, the situations of international child abduction, to which international law has not yet been able to provide an adequate response, stand out.

A experiência que tive durante os 6 meses de estágio curricular no Juízo de Família e Menores do Tribunal Judicial da Comarca de Mafra, mudou e alargou a minha perspetiva quanto às crianças, os seus direitos e as formas que existem para garantir a efetivação destes. Contudo, um longo caminho ainda se avizinha. A evolução dos Direitos da criança na família não tem sido homogénea nem pacifica, e é fortemente marcada por tentativas, muitas delas erróneas de consagração daqueles que, para nós, devem ser os princípios orientadores desta disciplina. É notória a constante mutação no âmbito do Direito da Família, que afeta diretamente o Direito das crianças, apesar de este consistir, no nosso entender, um ramo do direito autónomo face àquele. As mudanças a nível social, familiar e individual, aliadas à crescente europeização e internacionalização, trouxeram novos desafios jurídicos que colocam a criança perante situações de incerteza ao seu desenvolvimento. Dentro destas, destacam-se as situações do rapto internacional de crianças, às quais o direito internacional ainda não conseguiu assegurar resposta adequada.
