Solidariedade e Direito Internacional e Europeu no contexto da pandemia do coronavírus

Abstract

O objetivo desta dissertação é propor uma teoria da solidariedade enquanto forma de cooperação mútua através dos mecanismos jurídicos e institucionais internacionais, para o combate aos terríveis efeitos da pandemia. O trabalho está estruturado em cinco capítulos. A metodologia do primeiro capítulo é a revisão de literatura. Analisamos o conceito de solidariedade segundo o sociólogo Émile Durkheim, passando pelas distinções entre solidariedade mecânica e solidariedade orgânica, alcançando as bases para a construção do direito internacional segundo o jurista Georges Scelle. É, também, analisada a necessidade de uma solidariedade internacional conforme formulado por António Guterres, atual Secretário-Geral da ONU. A metododologia do capítulo segundo é a análise de legislação e de jurisprudência no âmbito europeu. Este capítulo trata das bases jurídicas e institucionais sobre as quais a União Europeia está formulada, relativamente às instituições mais atuantes no contexto pandêmico, sendo concebido, por nós, como a dimensão jurídica de solidariedade na Europa. A metodologia do capítulo terceiro é a análise de documentos políticos. Este capítulo traz os principais exemplos de atuação da União Europeia no combate ao coronavírus; suas principais medidas sanitárias e financeiras, dentre outras; é intitulado como dimensão política da solidariedade na Europa. Já no quarto capítulo, a metodologia é a análise de documentos jurídicos. Verifica-se, principalmente, a relação entre a ONU e o direito internacional, seus principais órgãos e diplomas legais relativos à atuação da Organização frente à pandemia; é nomeado como dimensão jurídica da solidariedade no mundo. Por sua vez, o quinto capítulo tem como metodologia a análise de dados e documentos políticos. Este capítulo elenca as ações mais relevantes da maior instituição internacional existente, assim como de seus braços regionais, órgãos e programas, na tentativa de minimizar os impactos da doença, nos níveis social, sanitário, econômico e humanitário. Por fim, são apresentadas as considerações finais acerca do exposto, promovendo reflexões a respeito dos questionamentos levantados e possíveis objetivos a serem alcançados para um aprimoramento de eficiência e coordenação da chamada solidariedade internacional.

The objective of this dissertation is to propose a theory of solidarity as a form of mutual cooperation through international legal and institutional mechanisms, to combat the terrible effects of the pandemic. The work is structured in five chapters. The methodology of the first chapter is the literature review. We analyzed the concept of solidarity according to sociologist Émile Durkheim, passing through the distinctions between mechanical solidarity and organic solidarity, reaching the bases for the construction of international law according to jurist Georges Scelle. The need for international solidarity is also analyzed, as formulated by António Guterres, current UN Secretary-General. The method of the second chapter is the analysis of legislation and jurisprudence at the European level. This chapter deals with the legal and institutional bases on which the European Union is formulated, in relation to the most active institutions in the pandemic context, being conceived, by us, as the legal dimension of solidarity in Europe. The methodology of the third chapter is the analysis of political documents. This chapter presents the main examples of the European Union's action in the fight against coronavirus; its main sanitary and financial measures, among others; it is called the political dimension of solidarity in Europe. In the fourth chapter, the methodology is the analysis of legal documents. Mainly, the relationship between the UN and international law, its main organs and legal diplomas related to the Organization's activities in the face of the pandemic is verified; it is named as the legal dimension of solidarity in the world. In turn, the fifth chapter has as methodology the analysis of data and political documents. This chapter lists the most relevant actions of the largest existing international institution, as well as its regional branches, agencies and programs, in an attempt to minimize the impacts of the disease, at the social, health, economic and humanitarian levels. Finally, the final considerations about the above are presented, promoting reflections on the questions raised and possible objectives to be achieved for an improvement of efficiency and coordination of the so-called international solidarity.
